PERFORMANCE WORK STATEMENT

PART 1

GENERAL REQUIREMENTS

PURPOSE

This solicitation will result in two Firm-Fixed-Price, Indefinite Delivery Requirements contracts each for one base year and four option years, and one possible six month extension of services option periods for the preparation of personal property of military members and civilian employees for movement, drayage, storage and related services for Marine Corps Base, Camp Pendleton, CA and Marine Corps Air Station Yuma, AZ. The Government anticipates awarding two contracts from this solicitation, one for those requirements at Marine Corps Base, Camp Pendleton and one for those requirements at Marine Corps Air Station Yuma.

ITEMS AND QUANTITIES

The line items described in Attachment 1 represent the Government’s best estimation of required items and their estimated annual quantities. The Government assumes no liability in the event that actual quantities do not materialize in the amounts estimated. Deviation from estimates will not be a basis for contract claim or request for equitable adjustment.

Note: The Government’s requirements might change or fluctuate during the term of this Contract. As Government requirements change, line items will be added or deleted as necessary. Only the Contracting Officer has the authority to negotiate modifications that affect price. These types of changes require a contract modification.

SEPARATE CONTRACTS

This solicitation is divided into SIX lots for proposal purposes. They are:

Lot I Camp Pendleton; Area I; All Schedules Lot II Camp Pendleton; Area II; All Schedules Lot III Camp Pendleton; Area III; All Schedules Lot IV Yuma; Area IV; Schedule I Lot V Yuma; Area IV; Schedule II Lot VI Yuma; Area IV; Schedule III

(see DFAR clause 252.247-7013 for further details). Individual awards will be for those lots within each of the two primary geographic areas (i.e., Marine Corps Base Camp Pendleton, and Marine Corps Air Station Yuma) that result in the best value to the Government, including the assumed administrative costs. As an example, Contract #1 convering Marine Corps Base Camp Pendleton will include Lots I, II, and III, while Contract #2 covering Marine Corps Air Station Yuma will include Lots IV, V, and VI.

Subcontracting. When it is in the best interest of the Government, the contracting officer may approve subcontracting in accordance with provisions of the DOD FAR Supplement, Part 252, Subpart 252.247-7018. Such approval will be confirmed in writing and coordinated with the personal property shipping officer. Any request/submission for use of subcontractors will only be considered if such subcontractors are DOD approved or meet the requirements as set forth in DTR.

Operating Authority Requirements for Contractors. The provisions of the FAR, 52.247-2, Permit, Authorities, or Franchises are applicable for qualification to perform services under this regulation. A prospective contractor engaged in interstate transportation shall be approved and hold authorization in their own name by the Interstate Commerce Commission, or, if engaged in intrastate transportation, a certificate issued by the appropriate state regulatory body will be required. In those instances where certain states recognize leasing and/or agency agreements to perform drayage services as an alternative to intrastate operating authority, the prospective contractor shall be responsible for furnishing such evidence of compliance with state law.

Performance Evaluation Meetings. The contractor shall meet with the Quality Assurance Evaluator, Personal Property Shipping Officer and Contracting Officer or designated representative once during the first month of the contract. Meetings will be as often as necessary thereafter as determined by the contracting officer. A meeting, however, should be held whenever a Contract Discrepancy Report (DD Form 2772) is issued. A mutual effort shall be made to resolve all problems identified. The written minutes of these meetings shall be signed by the Contracting Officer, Personal Property Shipping Officer and Quality Assurance Evaluator. Should the contractor not concur with the minutes, the contractor shall state in writing to the contracting officer any areas of nonoccurrence.

Compliance. The rights and obligations of the parties to the Performance Work Statement (PWS) shall be subject to and governed by the provisions of the PWS and the requirements and services contained therein. Requirements as listed in this Contract are inclusive of Defense Travel Regulation (DTR) Part IV requirements, as well as requirements applying to this Contract’s Area of Responsibility (AOR) only. Contractors awarded schedules under this contract will adhere to requirements in this Contract. To the extent of any inconsistency between the PWS and other military service regulations, the provisions of the PWS shall take precedence, unless a waiver is obtained.

Compliance with this PWS is mandatory.
