a) General
This contract sets forth the requirements for the uninterrupted delivery of Liquefied Petroleum Gas (LPG), Grade HD5 and rental of tanks at various locations on Marine Corps Base Hawaii, Kaneohe Bay and Camp Smith.
b) Definitions
Liquefied Petroleum Gas (LPG) – A fuel gas, which consists predominantly of propane, propylene, butanes (including isobutanes), butylenes, or any combination or dilution thereof.
2) DELIVERY OF LPG
a) The Contractor shall ensure that all tanks are kept supplied with adequate levels of LPG so that there shall be no disruption of services during normal working hours of the using activity.
b) All LPG delivered by the Contractor shall be measured by metering equipment of standard manufacturer, furnished, installed, maintained, calibrated, and read by the contractor at his/her own expense. In the event that any meter fails to register or registers incorrectly, the quantity of LPG delivered through it during that period shall be determined and an equitable adjustment based thereon shall be made in the Government’s Bills. Any meter which registers not more than two percent (2%) slow or fast shall be deemed correct. Failure to agree on any such adjustments shall be a dispute concerning a question of fact within the meaning of FAR 52.233-1 Disputes clause of this contract.
c) Delivery Ticket - The Contractor is responsible for obtaining a signature to confirm the delivered quantity at each delivery location specified in the Statement of Work and shall submit an electronic copy of the delivery ticket via email to Contracting Officer’s Representative (COR) (Merlinda Bertubin, merlinda.bertubin@usmc.mil or Lance Iwami, lance.iwami@usmc.mil) and the Administrative Contracting Officer (Steven Takasaki, steven.takasaki@usmc.mil). The delivery ticket shall state the delivery order number, the sub-contract line item number (subCLIN), and the amount of LPG delivered.
d) Monthly Report - The Contractor shall submit a monthly report to the Contracting Officer’s Representative (COR) for each Delivery Order within 10 working days of the end of each month. The monthly report shall contain a consolidated list of the quantities delivered to each tank. All delivered quantities shall be reflected on this report. If the quantity is zero, indicate “zero gallons delivered.” This is a separate requirement from the monthly invoicing requirements.

At the end of the contract, the contractor is responsible for the removal of all tanks should a new contractor receive the follow-on contract. The outgoing contractor may choose to sell the tanks that are already in place to the incoming contractor, but that is up to the discretion of contractors involved and it is not mandated by the Government. The Government shall be credited for any remaining LP Gas in any tanks that are removed from Government Property. (See paragraph #6 for further details on Transition Requirements.)

e) If new locations requiring LPG arise during the period of performance, a new delivery order will be issued (or an existing delivery order will be modified) to arrange for the additional LPG needs and tank rental. The contractor is responsible for providing and installing any additional tanks needed at no additional cost to the Government beyond the price for leasing the particular sized tank.
f) The Navy Inspector shall be present during any installation, maintenance, or repairs conducted on the tanks.
