VENDOR RESPONSE SUBMISSION:

Feedback on this requirement is encouraged. This is a market research tool used to identify market capability and solutions (to include performance work statement revisions), as well as the availability and adequacy of potential small business sources prior to determining the method of acquisition and issuance of award. The Government is not obligated to and will not pay for any information received from potential sources as a result of this notice. Information submitted by respondents to this notice is strictly voluntary. It is requested that firms submit answers to the MCINCR-RCO at the below email address. A vendor’s response should include the following information:

1. Business/Entity name, CAGE code, Unique Entity ID (UEI), primary contact name, telephone number, address, and email address.

2. The anticipated North American Industry Classification System Code (NAICS) for this requirement is either 561210 Facilities Support Services, or 561612 Security Guards and Patrol Services. If your business believes a different NAICS is more applicable to this requirement, please provide your NAICS suggestion with an explanation as to why the code(s) provided would better support this requirement. Responses are requested on what NAICS code the industry believes is best suited for this requirement.

3. Description of your organization’s capabilities / experience with regards to the draft PWS requirements. This description should demonstrate ability to perform the services in the draft PWS. Generic capability statements may not result in the Government having confidence that the vendor has demonstrated a reasonable expectation of understanding and/or potentially meeting the required services in the PWS. Tailored capability statements will assist our office in determining if a set-aside may apply or not.

4. Contract vehicles (GSA Federal Supply Schedule, GSA GWAC, or any other Government Agency contract vehicle), of which your business is a contract holder, for these required services, that is open for DoD agencies to award task orders under. If applicable, provide the Contract Number. If a GWAC is not applicable, it is not necessary to provide those details. Lack of a contracting vehicle does not prevent a business from responding to this notice.

Other than small
Example: GSA Alliant2
47XXXXXXX

Note: If the contracting vehicle is not relevant to these required services, it is not necessary to provide this information, as it would not apply to the acquisition.

5. Answers to the below specific questions regarding the requirement:

a. What additional information do you need to quote firm-fixed prices (FFP) for this requirement?

b. What areas of the requirement seem restrictive? Why? What are your suggestions to make areas less restrictive?

c. What areas of the requirement seem vague? Why? Please identify what they are and a recommended remedy.

d. What obstacles would prevent your business from submitting a future quote for this requirement? What is/are the solution(s)?

Note: Avoid mentions regarding set-asides as market research will dictate which set-aside, if any, apply. This question is regarding the technical aspects of the performance work statement, not small business set-asides and/or socio-economic categories.

e. Are the required services considered professional or are they subject to the Service Contract Act?

f. What are some industry norms for procuring these services? Please provide examples, details, and/or explanations.

g. Pursuant to FAR 16.301-3(b), the use of cost-reimbursement contracts is prohibited for the acquisition of commercial services/supplies. Further, FAR 12.207(a) mandates that agencies only use firm fixed-price (FFP) contracts, or fixed-price contracts with economic price adjustments, time-and-materials (T&M) contract, or labor-hour (LH) contracts for the acquisition of commercial items. This is commercial services; therefore, the resulting contract would be FFP, as cost-reimbursement is prohibited for commercial services/supplies.

Is your firm able to quote fixed prices for the required services?

Are there any areas that your firm would not be able to quote FFP, if so, what areas and what type of pricing is recommended and why (LH, T&M, etc.)? Keep in mind that the Government cannot use LH or T&M CLINs without a approved Determinations & Findings that contains sufficient facts and rational to justify that FFP type CLINs are not suitable.

h. The Government anticipates using the following CLIN and pricing structure, which is how the current contract is awarded. However, this RFI is encouraging interested sources to provide feedback that the Government will consider in developing the solicitation, regarding the CLIN and pricing structure. Sources are encouraged to provide feedback if the CLIN structure in the table below is recommended, or use of an alternative method is preferred. If suggesting an alternative method, please provide details and/or a sample breakout.
