52.212-2 ADDENDUM

52.212-2 ADDENDUM: EVALUATION – COMMERCIAL ITEMS

EVALUATION. The quote(s) will be evaluated on technical capability and price. The Government intends to make a single Firm Fixed Price order to satisfy this requirement. The Government reserves the right to award no contract at all, depending on the quality of offers submitted.

The Government intends to evaluate quotes and award a contract without discussions with vendors. Vendors should not expect requests for clarification or additional information from the Government. Award will be based on the initial evaluation of quotes received in response to the solicitation. Therefore, quoters are cautioned that their initial quotes should contain their best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions with vendors if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; and may waive informalities and minor irregularities in quotes received.

The Basis for award is PRICE AND OTHER FACTORS per FAR 13.106-1(a)(2).

All quotations or offers will be ranked in the order of lowest price to highest price and the below factors will be used.

The following factors shall be used to evaluate Quotes:

RATING DEFINITION

Acceptable Quote meets the requirements of the solicitation.

Unacceptable Quote does not meet the requirements of the solicitation.

The Government may use information such as DoD PPIRS, SPRS and FAPIIS data available from Government sources to evaluate a Quoter's past performance.

Factor 1 – Technical Capability To ensure technical compliance the Quoter must clearly demonstrate that they can meet the solicitation requirements. The manufacturer’s name and manufacturer’s complete part numbers of all items quoted shall be submitted in the quote. A mere statement that the quoter will meet the Government’s requirement is NOT sufficient.

The Government will evaluate website links of samples of Motion Graphics and Voice/Graphics to assess technical capability.

Factor 2 – Pricing The Government will evaluate Quoter’s quoted prices, but this factor will not be given an adjectival rating. Quotes will be evaluated on completeness, accuracy, and reasonableness. Evaluation of the quoted prices for the services will be based on a comparison of quoted prices received in response to the solicitation and may also be based on a comparison to the Independent Government Cost Estimate (IGCE) along with any other relevant price analysis techniques.

Reasonableness. For the price to be reasonable in its nature and amount, it should not exceed that which would be incurred by a prudent person in the conduct of a competitive business. Reasonableness takes into account the context of a given source selection, including current market conditions, general economic conditions, and other factors that affect the ability of a Quoter to perform the contract requirements. Normally, adequate price competition establishes a fair and reasonable price.

Completeness and Accuracy. The Government will review the pricing tables for completeness and accuracy. A determination will be made as to whether the Quoter properly completed the pricing tables. The Quoter’s quote will be checked for mathematical correctness to include the following:

1) Checking arithmetic in all computations; and

2) Ensuring all prices are summarized correctly.

Factor 3 – Past Performance The Supplier Performance Risk System (SPRS), available at https://piee.eb.mil/, will be used in the evaluation of the Quoter or Offeror’s performance. The apparent successful, prospective contractor shall have at minimum, satisfactory past performance.

In accordance with FAR 13.106-2(b)(3)(ii) and DFARS Subpart 204.76, the Contracting Officer will consider the price, supplier an item risk assessment generated by the Supplier Performance Risk System (SPRS), if available, as part of the award decision.

STATEMENT OF WORK

STATEMENT OF WORK

Modernize Prevention Education

1.0 Background: United States Marine Corps (USMC) has a requirement to modernize the USMC’s prevention education portfolio with still and motion graphics and/or images.

2.0 Scope: This Statement of Work (SOW), for the procurement and delivery of all still and motion graphics and/or images. The contractor shall be required to create twenty-five (25) to thirty-five (35) still and motion graphics and/or images to support the USMC’s prevention education portfolio requirement to Marine and Family Programs, Behavioral Programs Curriculum & Development team.

The graphic/image solutions will also be kept for use by Curriculum Development and Behavioral Programs who will use these graphics to modernize prevention education, in other Behavioral Programs’ applicable materials, without restriction to Marine Corps use of the preceding or any other uses.

3.0 Tasks and Specifications: The contractor shall create graphics and/or images, both still and motion, in mainly HTML5 (embedding images to or for web based uses) and MP4 (YouTube type style).

3.1 Contractor shall design and create comic-like graphics of Marines (still and motion) in character form and in scenes where they are depicted physically fit, with Superhero characteristics, in true Marine civilian dress as well as in Marine uniform(s). These Marine comic-like graphics will capture all demographics. None of the graphics/images shall be disparaging to the Marine Corps or the entities portrayed. Image releases should be obtained for graphics that are based on living individuals or third party proprietary materials.

3.2 Contractor shall design and create Marine comic-like images for the following 10 topics:

1. Climate Briefs: From All-Hands to small discussion groups, commit to having routine, ongoing conversations about command climate. Active listening increases your understanding of team concerns and empowers you to adapt as needed.

2. Walk The Deck: Daily engagement builds rapport, trust and confidence between leaders and Marines. You are more likely to learn about potential harmful behaviors when you take part in direct conversations with your Marines in real time. These personal interactions show that you respect your fellow Marines, subordinates and superiors, and care about how they are doing.

3. If You See Something, Say Something: If you see or hear inappropriate conduct or unacceptable behavior, such as the telling of sexual “jokes” or the attempts to establish unwanted romantic or sexual relationship, in public, respond immediately. On the spot corrections communicate standards of professional and appropriate conduct for all Marines and dispel any confusion about conductor or behavior.

4. One Size Does Not Fit All: A single set response to every command climate issue is unlikely to work. In a learning institution, mistakes can be opportunities to learn and grow, and not all comments made are intended to be malicious. As a positive leader with your finger on the pulse of command climate, you can improve morale and esprit de corps by taking all reports seriously and addressing them in a swift manner.

5. Do Not Wait Until It Escalates: Early intervention is important. Watch List behaviors are indicators of eroding good order and discipline within your command. Stopping these behaviors early and consistently can prevent more serious destructive behaviors from occurring over time.

Watch List Behavior Topics (More Specifics, if needed will provided post award)

1) Reaction to Trauma (Revictimization)

2) Positive Focused Watchlist

3) Healthy Relationship & Online Communication

4) Unit Cohesion Healthy Boundaries In The Gym

5) Inclusion

6) Elements Of A Healthy Command

7) Leadership Taking Action/Accountability

8) Healthy Relationships In General (Respect)

9) Effective Communication

10) Importance of Social Support & Self-Care When Dealing With Traumatic Events.

6. Take All Sexual Harassment Complaints Seriously: Trust your Marines when they report sexual harassment, as they are trusting you to uphold the standards. Studies show most people have tried everything they can to resolve the situation before making a sexual harassment complaint.

7. Look Beneath The Surface: Complaints about Watch List behaviors may indicate deeper issues. Use additional assessment tools such as a command climate survey to better understand how your Marines are experiencing the climate. Action what you know. Remain flexible and ready to pivot as climate information comes to your attention.

8. Develop A Reporting Culture: Cultivate a command climate where Marines have confidence to report without fear of reprisal. A firm, fair and consistent approach to reporting wrongdoing builds confidence in the systems that support Marines. Trivializing Watch List behaviors could lead to a more permissive command climate.

9. When In Doubt, Call In The Experts: Most of the Watch List behaviors are violations of Marine Corps instructions and the Uniform Code of Military Justice. Routinely check in with a Judge Advocate officer or other relevant subject matter experts if you are unsure about how to respond to a potential issue.

10. Do Not Delegate It. Own It: Make sure everyone understands your goal is to help and protect those under your command. Hold yourself accountable. If health and welfare are at risk, then you absolutely want to be informed and involved.

3.3 Contractor shall design and create individual and collective actions through motion graphics, approximately one minute in length with visuals for the following Elements of a Healthy Command (that reduce the likelihood of SAPR-related issues) 10 topics:

Cohesion- Cohesion assesses whether individuals in a workplace care about each other, share the same mission and goals, and work together effectively. Cohesive organizations are linked to improved readiness and retention, and a lower likelihood of sexual assault, sexual harassment, and suicide.

Connectedness- Connectedness measures perceptions of closeness to a group and satisfaction with one’s relationship to others in the group. Higher connectedness is linked to improved readiness, higher retention, and a lower likelihood of suicide.

Engagement and commitment- This factor measures the extent to which one finds their work fulfilling and is committed to their job and organization. Engaged and committed individuals demonstrate enthusiasm for, and dedication to, the work that they do. Higher levels of engagement and commitment are linked to improved readiness, higher retention, and a lower likelihood of suicide.

Fairness- Fairness is the perception that formal and informal organizational policies, practices and procedures regarding information sharing, job opportunities and promotions are based on merit, inclusion, equality, and respect. Organizations with fair treatment are linked to improved readiness, higher retention as well as lower likelihood of sexual harassment and racial/ethnic harassment and discrimination.

Inclusion- Inclusion indicates whether individuals are treated fairly and respectfully, have equal access to opportunities and resources, and can contribute fully to the organization’s success. Inclusive work environments ensure that it is safe for an individual to voice their different opinions, perspectives, and/or suggestions. Inclusive organizations are linked to a lower likelihood of racial/ethnic harassment and discrimination, improved readiness, and higher retention.

Leadership support- Leadership Support is the perception over the past three months that leaders build trust, encourage goal attainment and professional development, promote effective communication, and support teamwork. Organizations with supportive leaders are linked to improved readiness, higher retention, as well as a lower likelihood of sexual assault, sexual harassment, and suicide.

Morale- Morale is the confidence, enthusiasm, collective pride, and willingness to persist in the activities of the group. Organizations with high morale are linked to improved readiness, higher retention, and a lower likelihood of sexual assault.

Transformational leadership- This factor measures the perception over the past three months that leaders encourage, inspire, and motivate others to meet new challenges and accomplish tasks beyond what they felt was possible. Characteristics of a transformational leader include idealized influence or charisma, inspirational motivation, intellectual stimulation, and individualized consideration. Organizations with transformational leaders are linked to improved readiness and higher retention.

Work-life balance- This factor measures one’s perception that the demands of their work and personal life are compatible. A work-life balance is linked to higher retention, improved readiness, and a lower likelihood of suicide.

Safe storage for lethal means- Safe Storage for Lethal Means measures how often one keeps objects that can be used to hurt themselves or others, such as firearms and medication, safely stored in their living space. Keeping lethal means safely stored is linked to a lower likelihood of suicide.

4.0 Government Furnished Property/Intellectual Property/Deliverables: Finished files of the still and motion graphics and/or images for production (“Items”) shall be transferred in Adobe Pro, HTML5 and MP4. The Contracting Officer’s Representative may require that these Items/files to be password protected. Unless otherwise authorized by the Contracting Officer, the Contractor will not use the Contractor's or a Third-Party's proprietary data, information, software items and/or other materials for any purpose without meeting the requirements of DFARS clause 252.227-7020, and without the specific, written approval by the Contracting Officer, prior to start of any work.

All Contract developed, generated and/or produced images and other Items, and all associated intellectual property, completed or in progress under the contract will be solely and fully owned by the Government (“Deliverables”). The Contractor will transfer all Contract Deliverables/Items, and all associated intellectual property, completed or in progress, to the Government, if not already delivered, upon contract completion.

The Marine Corps is required to have unrestricted access and use of all Deliverables/Items upon delivery.

The Contractor will provide all Deliverables/Items in a version, format, and media used/useable and modifiable by the Marine Corps. Therefore, unless otherwise directed by the COR, the Deliverables/Items identified in this SOW will be delivered in a media and an electronic format compatible with resources currently being used by the Government.

Moreover, the Contractor is obligated to protect from unauthorized use or disclosure all Government confidential or classified material and/or Government-owned proprietary, and/or Personally Identifiable Information or Personal Privacy, Items obtained in the course of performance under the Government contract, as long as such Items remain proprietary, confidential, sensitive or classified. Contract personnel will not publish, divulge, disclose, or make known Items in any manner, or to any extent not authorized by the Contract, and Contractor personnel will not publish, divulge, disclose, or make known this information/Items/Deliverables in any manner or to any extent not authorized by the Contracting Officer.

When the Contractor's need for such Items ends (including all database or GFI/GFE items), the Items will be returned promptly (within 10 business days or as required by Section 5.0) to the appropriate Government program personnel. However, the obligation not to discuss, disclose, release, reproduce or otherwise provide or make available such Items, or any portion thereof, will continue, even after completion of this contract/order. Any actual or suspected unauthorized use, disclosure, release, or reproduction of any Items or violation of this agreement, of which the company or any employee is or may become aware, will be reported promptly (within one business day) to the Contractor's program manager, who will inform the Contracting Officer within 5 business days of receiving such report.

5.0 Period of Performance and Delivery: The contractor shall provide all final images sixty (60) days after contract awarded.
