QUESTIONS AND ANSWERS
QUESTIONS AND ANSWERS FOR SOLICITATION M00264-12-R-0022
Q-1. There is no reference to "Berry Amendment" compliance. Past solicitations/contracts issued from this contracting office, for USMC uniforms, have included the Berry compliance requirement. If there is no Berry compliance requirement, can you please advise as to why? And can the solicitation be modified to include Berry compliance?
a) If there is no Berry compliance requirement, can you please advise as to why?
A-1a Yes, this requirement does require the Berry Amendment and the solicitation will be amended to reflect the proper clauses.
b) Can the solicitation be modified to include Berry compliance?
A-1b Yes
Q-2. Regarding Pricing, the solicitation states this will be a firm/fixed price contract. Given the wide range between min/max quantities involved, is there any provision for the contractor to offer a tiered pricing schedule, based on quantity ordered? For example, 1 -10, 11- 49, 50 -99, 100+, etc.
A-2. No there is no current provision regarding tier pricing, however, the offerors are more than welcome to provide tiered pricing. Keep in mind that all offerors must provide pricing information for the minimun quantity required for evaluation purposes.
Q-3. Under "Order Limitations", 52.216-19, page 29 - (a,b) - The document states the contractor is not obligated to honor any order less than 10 units or for a single item in excess of 1000 units or any combination of items in excess of 1000 units. On Page 11, under IDIQ information, section 4 states a minimum estimated quantity value of 5
(coats/collars) and estimated maximum quantity of 1250 (coats/collars). In the next section "IDC Constraints", it states minimum quantity of 5 and maximum quantity of 5,410. Can you please clarify with regard to minimum/maximum quantities?
A-3. Clause 52.216-19 has been revised as follows:
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than 5, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor: Any order over the total contact maximum quantity amount.
Q-4. Does the middle of Page 13 “RED AND BLACK COATS” constitute the start of the “Statement of Work” and conclude on page 21 with 9.0 Wide Area Work Flow (WAWF) Instructions? We cannot identify a line or section that delineates the Statement of Work.
A-4. Yes
Q-5. Our understanding of the submission requirement, as outlined on page 36, is that the Business Volume (II) –
Phase II is NOT to be submitted until the vendor has been notified that they are one of the three qualifying Phase I.
Does this supersede the instructions on page 35, where it is stated that “Each proposal shall contain… Technical
Volume (I), Business Volume (II)? If bidders are not to include Phase II response information with their, should the price sheet (SF1449) not be included or left blank in the initial response, due 9/2/12?
a) Does this supersede the instructions on page 35, where it is stated that “Each proposal shall contain…
Technical Volume (I), Business Volume (II)?
A-5. Yes, 52.212-1 Addendum will be updated to reflect the following:
Proposal content: Each proposal shall contain the following as associated to the corresponding phase:
Phase I – Technical Volume and Phase II – Business Volume (II).
b) If bidders are not to include Phase II response information with their, should the price sheet (SF1449) not be included or left blank in the initial response, due 9/2/12?
A-5. Offerors shall NOT be required to complete the pricing (section B) of the SF 1449 for phase I. ONLY the high three (3) offerers after being contacted that there technical & past performance (Vol I) have qualified for the competitive range.
