About this file
This is a Limited Source Justification document from the U.S. Equal Employment Opportunity Commission (EEOC) for modifying Task Order #45310020F0161 under GSA Federal Supply Schedule Contract #GS00F009DA. The modification requests an increase to the total ceiling amount by less than 10% to fund Option Year 3 for a 4.5-month period, plus funding for a 12-month logical follow-on task order.
The justification supports continuing EEO Data Collections support services provided by the incumbent contractor Westat. The follow-on task order will allow OEDA to maintain critical data collection services while preparing to recompete the requirement for a new five-year contract. The justification cites both "only one capable source" and "logical follow-on" as rationales. The services support over 110,000 EEO filers with improved filing experience, technical assistance, and customer service. The agency states that disrupting the current contractor's services would delay deliverables and mission-critical data initiatives. The requirement will be recompeted with new market research within 12 months if deemed necessary.

2. Nature and/or description of the action being approved.
Modification is proposed to increase the total ceiling of EEOC Task Order # 45310020F0161 under GSA Federal Supply Schedule Contract # GS00F009DA to allow for the obligation of funds at the original proposed funding level for Option Year 3 (OY3) for a 4.5-month period and to obligate funds for an associated one-year logical follow-on task order, pursuant to the existing terms and conditions of the original task order. The proposal of a logical follow-on task order is to allow OEDA to continue EEO Data Collections support services for twelve (12) months, allowing time to recompete the requirement for a subsequent five-year contract or task order consisting of a 12-month base year plus four (4) one-year options.
The action will ensure that OEDA project objectives and deliverables are met, and business continuity is sustained. Moreover, the contractor will be able to successfully administer all the collections and associated activities relating to improved filing experience, technical assistance, and customer service to the over 110,000 associated EEO filers.
3. A description of the supplies or services required to meet the agency's needs
(including the estimated value).
OEDA is requesting that the ceiling amount of EEOC Task Order # 45310020F0161, for a continuation of support services for the EEO data collections, be raised by , less than 10% of the total task order value.
Further, a request is made that funds are obligated for a 12-month logical follow-on task order under a GSA federal supply schedule in accordance with the terms and conditions of the existing task order for a continuation of the services in the best interest of the government. The total estimated value of the proposed logical follow-on is for FY 2024 for five months plus for seven months subject to the availability of FY 2025 funds).

The logical follow-on action will be issued under the GSA schedule, and it has already been determined that the pricing under Schedule Contract No. GS00F009DA is considered fair and reasonable in accordance with FAR 8.404(d).
6. Description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Not applicable based on the continued required support of tasks under Westat task order number
7. Other facts supporting the justification.
The aforementioned task order will be extended to avoid a lapse of support under open tasks as referenced in the fourth option period under the above-referenced task order. A mission critical data initiatives, and the current contractor could not maintain the continuity of services and complete pending tasks.
