Limited Source Justification (LSJ) In accordance with FAR 8.405-6

1) Identification of the Agency, Contracting Activity, and Document

Procurement Office: General Services Administration (GSA) – Region 10, Federal Acquisition Service (FAS), One Acquisition Solution Integrated Services (OASIS)

Agency: United States (U.S.) GSA- One Acquisition Solution Integrated Services (OASIS) Program Management Office (PMO)

Task ID: GSO140001 Description of Requirement: Senior Contract Support Services in support of the OASIS PMO Total Estimated Value of the Action (based on the Independent Government Estimate (IGE)):

Period of Performance (PoP): February 1, 2017 to October 31, 2017 (3 Month Base Period and Two, 3 Month Option Periods).

Contractor Name: Integrity Management Consulting, Inc. (IMC) Procurement Vehicle: The Professional Services Schedule (PSS), Special Item Number (SIN) 874-6 Acquisition Support Services, Contract No. GS-00F-071DA - Task Order No. GSO140001. The previous Contract No. was GS-10F-0186U, before the migration to the PSS combined schedule took place.

2) Description of Action Being Approved

This LSJ supports a logical follow-on to GSA PSS Contract, GS-00F-071DA, Task Order (TO) GSO140001, because the task order option to extend services and option to extend the term of the contract clauses have been utilized to their fullest extent, therefore to continue services the authority at FAR 8.405- 6(a)(1)(i)(C) is being utilized. Under the aforementioned contract, IMC is tasked to provide Senior Acquisition Support Services for the OASIS PMO. The LSJ will allow the GSA OASIS Program Office to subsequently award a non-competitive extension of services modification for logical follow-onto work currently being conducted under the task order GSO140001 with IMC for a period of February 1, 2017 to April 30, 2017 (Base period) with two options to extend from May 1, 2017 to July 31, 2017 (Option 1), and August 1, 2017 to October 31, 2017 (Option 2).

The period of performance for the Base Period shall be three months. Two additional 3 month Option Periods may also be required thereafter, if so exercised by the Government in accordance with FAR Clause 52.217-9 – Option to Extend the Term of the Contract.

FAR 8.405-6 Limited Sources Orders placed under Federal Supply Schedules are exempt from the requirements in Part 6. However, an ordering activity must justify its action when restricting consideration in accordance with FAR 8.405-6, “Limiting Sources” —

3) Description of Supplies or Services Required

The Performance Work Statement (PWS) for the follow on services will similarly reflect that of the current PWS, providing for the continuation of OASIS PMO support services for a maximum of a nine (9) month period (if the option periods are exercised). In collaboration with the Government, IMC will support the continuation of the scope of work that was originally awarded on (enter date the task order as awarded) under the task order. The scope of the requirement includes, but is not limited to: document development, various administrative contracting support and program support tasks, work flow tracking and follow-up, and customer and vendor support activities.

4) Authority and Supporting Rational Permitting Acquisition using Limited Sources

FAR 8.405-6(a)(1)(i)(C)): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule (FSS) order. In December 2014, GSA Region 10, which is now the Professional Services and Human Capital (PSHC) Portfolio awarded GS-00F-071DA/ GSO140001 to IMC competitively and was not previously issued under a sole source or through limited source procedures. The purpose of the task order was to obtain contract support services for the OASIS PMO to provide a full range of Acquisition Support Services; i.e. administrative, program, technical, functional, and managerial expertise.

The primary reason this non-competitive action is being issued at this time, is due to the uncertainty in the political climate, and a hiring freeze that is being enacted as a new Presidential Administration takes office and the absolute need for the support services performed hereunder to continue. The current task order period of performance ends on January 31, 2017, and while there is approval to hire Government personnel to fulfill the requirements of the scope of the task order, there no time for the Government to execute the hiring action (recruitment, interviewing, selection, and onboarding) prior to the inauguration of a new president on January 20th, 2017.

In light of the challenge described above, the government still has the need for the mission-critical support services in the OASIS PMO to continue, and therefore an interim solution has to be developed. The interim solution is to non-competitively extend the current order under the auspices of logical follow-on, for the shortest period possible, until one of two of the following options can be achieved: 1) a waiver may be granted to the hiring freeze, or the hiring freeze lifted, so that the approved Government personnel may be hired or, 2) a new competitive task order can be solicited, evaluated and awarded until the hiring freeze is lifted or a waiver can be written and approved. This extension is a temporary “bridge” that will allow the continued support in the wake of the aforementioned challenges.

The requirements defined in the scope of work that are fully incorporated into the task order number GSO140001, are critical to functions that must be performed in support of the OASIS Program and directly impact Federal Government procurement offices world-wide. While a monetary impact value that would result from a lack of the services being performed is hard to quantify, it is factual to say that if a lapse in service was to occur, the program would not be able to operate in a manner compliant with internal GSA acquisition standards and controls; thereby adversely impacting the OASIS PMO’s ability to serve its Federal Government customers.

The current task order, GSO140001, will expire on January 31, 2017.

5) Determination by the Contracting Officer that the Anticipated Order Represents the Best Value

The anticipated cost to the Government is approximately $78,448 (3 Month Base) + $10,000 (Travel Expense) + $140,208 (Two 3 Month Options) totaling $218,656 for the entire 9 months. The Government has already determined the prices under the PSS schedule contract to be fair and reasonable. In addition, prior to award the contracting officer will conduct a price analysis utilizing the guidelines in FAR 15.404- 1(b) and confirm the prices offered in response to the extension of services Request for Quote (RFQ) are fair and reasonable, prior to awarding the modification to the original task order. Discounts off the schedule and/or proposed rates may be requested.

6) Description of the Market Research Conducted

The current task order was issued under IMC’s Mission Oriented Business Integration Services (MOBIS) Schedule Contract. The MOBIS (874) schedule is no longer available as an individual Multiple Award Schedule program. All of the services covered under this schedule, and all of the existing contractors, are available under the new PSS, and the new contract number is: GS-00F-071DA, the pricing did not change, and remains fair and reasonable. Further information about the merger of the contractor’s professional services contracts may be retrieved from the IMC’s procuring contracting officer.

The Government is continuing to conduct market research in support of a competitive acquisition for these services from the commercial market. In accordance with FAR 8.405-6(a)(2)(i) this LSJ will be posted on Federal Business Opportunities (FBO) for a minimum of 30 days. This will provide additional information to ensure the Government has sufficient information from industry to finalize the ongoing market research and prepare a successful acquisition strategy. The goal is to fill the requirements with Government personnel as soon as the hiring freeze is lifted, or recomplete the action if the freeze is not lifted prior to the end of the period of performance under this task order extension action.

7) Other Facts Supporting the Justification

The Contracting Officer has determined that the temporary extension of the task order represents the best business decision and value to the government, and will serve to continue the much needed services under the current task order, with the current contractor who has the staff in place and the program knowledge to continue supporting the OASIS Program without interruption. The execution of the task order under the authority cited in this LSJ is in the best interest of the Government given the current political climate, and the needs of the Government at this time.

8) Statement of Actions to Overcome Barriers of Competition

It is the Government’s intent to allow for competition on all requirements. The Government will continue market research supporting a competitive award. The Government will publicly post this justification document in accordance with FAR 8.405-6(a)(2)(i). A combination of the efforts discussed in this LSJ section will assist in overcoming barriers to competition going forward.
