Justification for Other than Full and Open Competition IAW FAR
1. Nature and/or description of the action being approved:
2. A description of the supplies or services required to meet the agency’s needs (including the estimated value):
3. An identification of the statutory authority permitting other than full and open competition
4. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
6/24/2016
DLA Document Services has a need to issue a sole source contract action to continue services without using competitive procedures. The competed delivery order SP7000-12-D-1003-0412 was awarded on 4/20/2016 with a PoP start date of 7/01/2016. The existing delivery order SP7000-12-D-1001-0003 expires on 6/30/2016.
Original contract provided for leased multi-functional devices (MFDs), full service maintenance, all consumable supplies (excluding paper), key operator training, networking functionality, security accreditation along with technical and network installation support. Estimated value$10,825.33.
The statutory authority permitting other than full and open competition is 41 U.S.C.
1901.
The authority identified in #3 above applies because, although other vendors offer similar MFDs, consumables, and services; no other vendor can service the lease of another vendor without violating the lease terms. Additionally, no other vendor would be able to deliver new devices in time for a 7/1/2016 start date. The only way to ensure uninterrupted support to the Warfighter is to issue a contract to the current vendor.
5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
6. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted:
7. Any other facts supporting the use of other than full and open competition, such as:
Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.
8. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition (Include the results of the request for information or the sources sought notification in accordance with DFARS PGI 206.302-1 or include the waiver from the HCA or designee):
Although this contract requirement can only be fulfilled by one source, the Justification and Approval per FAR 13.501(a)(1)(iii) will be synopsized via the Government-wide Point of Entry, Federal Business Opportunities website. The follow on order for the devices was awarded utilizing full and open competition.
Market research indicates that an adequate competition pool exists for requirements of this type. The contract will only be in place for one month to allow new devices to be delivered that are replacing the existing MFDs.
Attempting to do a short-term contract via competitive procedures would result in unacceptable delays to achieve contract award and delivery/installation of new equipment; both of which would cripple the customer. The unacceptable delays would entail removal of the 63 devices currently in place, re-competing the short term rental, and delivery of the short term rental, during which the customers would be without devices. A one (1) month contract will provide adequate time for the delivery and installation of new devices.
None.
