DLA Contracting Services Office – Philadelphia (DCSO-P)
SUBJECT: LSJ – MINITAB MAINTENANCE
Source Selection Information – See FAR 2.102 & 3.104 For Official Use Only (FOUO) deployment, the ODCMO’s CPI office purchased Minitab for various DoD organizations, including DLA. Other similar products are generic and provide general features and functionality, while Minitab provides the required specific CPI/Six Sigma functionalities that has been embraced, standardized, and used widely throughout the DoD community.
Therefore, the guidance outlined under FAR 8.405-6(b) and the aforementioned provides the rationale for limiting the source for the referenced software requirement to Minitab. Minitab- 19 (or most current version available and compatible with DLA infrastructure) is the standard software for CPI events within DoD across multiple enterprise platforms. Procuring another manufacturers software is not feasible as to do so would have negative enterprise-wide impacts throughout DLA. New licenses would have to be procured, implemented, and training conducted, which could negatively impact the enterprise in its ability to support present and future CPI events. Additionally, data collected and stored from past and ongoing events would be rendered useless as no guarantee can be made that a new program would be able to read and process data previously generated via the Minitab suite of software.
5. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE:
In accordance with (IAW) FAR 8.404(d), prices negotiated on GSA/FSS’s have already been determined to be fair and reasonable by the Contracting Officer and therefore, considered to be the “best value” for the Government. Minitab, LLC has an established ESI agreement (N00104-08-A-ZF30 (validated at, http://www.esi.mil/Search.aspx?submit=search&q=N00104-08-A- ZF30&Digest=2DR4F/Te0/9DDeRyWGe2sQ )) for Minitab software licenses and ESI is a required “first source” for Government software requirements IAW DFARS 208.7400(d), thus meeting the best value requirements for this request. The terms and usage of this agreement are in accordance with DFARS 208.7400(d). Pricing will be based upon an ESI agreement, which includes negotiated discounts to GSA/FSS pricing. The Contracting Officer still reserves the right and must within their warrant authority determine that pricing is fair and reasonable and represents the best value to the Government. As Minitab, LLC holds an ESI agreement which has been negotiated IAW with the guidance outlined under FAR 8.404(d), this request is consistent with standard best value practices for purchases made under a Federal Supply Schedule and therefore is consistent with the guidance outlined under FAR 8.404(d) and DFARS 208.7400(d) for “REQUIRED SOURCES OF SUPPLIES AND
SERVICES”.
6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:
Market Research was conducted to find possible sources for the requested maintenance.
There is only one source available for this requirement - Minitab, LLC. No other vendor can provide the maintenance support required to support of Lean Six Sigma (LSS) activities within DLA. Minitab Maintenance is the only product that can meet this requirement.

7. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE EXCEPTION TO
FAIR OPPORTUNITY BEFORE ANY SUBSEQUENT ACQUISITION FOR THE
SUPPLIES OR SERVICES IS MADE:
At this time, Minitab Maintenance is the only product capable of meeting the Government’s needs. However, DLA has exercised, and continues to exercise, competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government. DLA uses a variety of vendors, manufacturers, and contracts/order to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition to the maximum extent practicable.
