About this file

This is a Justification for Limiting Sources (LSJ) document for a firm fixed-price, one-year Delivery Order under the General Services Administration Federal Supply Schedule (FSS).

The Department of Veterans Affairs, Network Contracting Office 10, is awarding a sole-source delivery order to Olympus America, Inc. for replacement Olympus OES ELITE 4mm HD Telescopes to support urological procedures at the Louis Stokes Cleveland VA Medical Center. The requirement includes 17 units each of three telescope configurations: WA2T412A (12-degree), WA2T430A (30-degree), and WA2T470A (70-degree), with a trade-in of 17 existing telescopes. The telescopes are essential components of cystoscopy trays used for cystoscopy, transurethral resection of the prostate (TURP), and transurethral resection of bladder tumors (TURBT) procedures. The existing telescopes are well past end-of-life, many are bent, and pose potential harm to patients. The required delivery date is 30 days after receipt of order. The procurement is awarded against FSS Contract No. 36F79721D0168, with Olympus America, Inc. identified as the original equipment manufacturer and First Nation Group as an authorized distributor.

The justification cites FAR 8.405-6(a)(1)(i)(B), establishing that only one source is capable of providing the supplies at the required quality level because the supplies are unique or highly specialized. Market research identified alternative manufacturers including KARL STORZ and Richard Wolf offering 4mm rigid surgical telescopes with similar viewing angles; however, these alternatives do not meet the specific requirement for full compatibility with the existing Olympus OES Pro System. The Nonmanufacturer Rule applies under NAICS 339112, and the VA and SBA Rule of Two could not be met, as no two certified SDVOSB/VOSB vendors were identified capable of meeting the Government's requirements. The Contracting Officer, Rachelle J. Hamer, signed the justification on August 24, 2026.

2. Description of Action: Network Contracting Office (NCO) 10 intends to award a new firm fixed-price, one-year Delivery Order (DO) to Olympus America, Inc. for Olympus OES ELITE telescopes. The Department of Veterans Affairs requires replacement telescopes to support urological procedures for Veterans at the Louis Stokes Cleveland VA Medical Center (CLE VAMC). The requirement includes Olympus OES ELITE 4mm HD Telescopes in 12-degree, 30-degree, and 70-degree viewing configurations. The telescopes are an essential component of the cystoscopy trays used by the Urology Section for cystoscopy, transurethral resection of the prostate (TURP), and transurethral resection of bladder tumors (TURBT). The existing telescopes have been in use for many years, are well past end of life, and many have been bent or can no longer be used safely. The replacement of the existing telescopes will help maintain functional cystoscopy trays, prevent delays in patient care, and support the continued delivery of urological procedures for Veterans.

Acquisition ID#: 36C250-26-AP-0482

The Olympus OES ELITE telescopes are essential components of the cystoscopy trays used by the Urology Section for cystoscopy, transurethral resection of the prostate (TURP), and transurethral resection of bladder tumors (TURBT). The requirement is to replace the existing telescopes, which have been in use for many years and are well past end of life. Many of the current telescopes have been bent over years of use and can no longer be inserted into the resection piece without causing damage to the scope and potential harm to patients. The OEM has denied repair or replacement of the existing telescopes due to their age.

The requested OES ELITE 4mm HD Telescopes provide 12-degree, 30-degree, and 70-degree viewing configurations and are compatible with the existing Olympus OES Pro System.

Replacing the existing telescopes will help maintain functional cystoscopy trays, prevent delays in patient care, and support the continued delivery of urological procedures for Veterans. This procurement directly supports the Department of Veterans Affairs' mission to improve the health, well-being, and continuity of care for the Veteran population.

4. Authority:

Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

(FAR 8.405-6(a)(1)(i)(B));

5. Rationale/explanation to support cited authority:

The Contracting Officer, working with Service, conducted market research to identify commercially available rigid surgical telescopes capable of meeting the Government's minimum requirements for the Louis Stokes CLE VAMC.

Before beginning that research, the Government identified the minimum functional requirements for the requested equipment. At a minimum, the required telescopes had to provide 4mm high-definition visualization in 12-degree, 30-degree, and 70-degree viewing configurations; be compatible with the existing Olympus OES Pro System; support the existing procedures performed by the Urology Section, including cystoscopy, transurethral resection of the prostate (TURP), and transurethral resection of bladder tumors (TURBT); and replace the existing Olympus telescopes currently used as part of the cystoscopy trays. The Olympus telescope is considered the core part of the cystoscopy tray and is used for cystoscopy, TURP, and TURBT procedures.

The Contracting Officer confirmed that the required Olympus OES ELITE 4mm HD Telescopes are available under FSS Contract No. 36F79721D0168. Olympus America Inc. is the OEM manufacturer, and Olympus has identified First Nation Group as an authorized distributor. The exact requested models are WA2T412A, WA2T430A, and WA2T470A, which correspond to the required 12-degree, 30-degree, and 70-degree configurations. The Government's existing telescopes identified for trade-in are the A22001A, A22002A, and A22003A models.

On August 24, 2026, the Contracting Officer reviewed GSA Advantage, National Contracts, ECAT, SAM.gov, Interagency Contract Directories, NAC, FPDS, SCMC, OMB, and BIC using keywords including “OES ELITE,” “4mm telescope,” “12 degree telescope,” “30 degree telescope,” “70 degree telescope,” “cystoscope,” and “rigid surgical telescope.” SBA Small Business Search was also reviewed under NAICS 339112. Market research identified other rigid surgical telescopes available through Federal Supply Schedule contracts, including KARL STORZ HOPKINS II 4mm 30-degree and 70-degree telescopes available through FSS Contract No.

36F79723D0185, as well as Richard Wolf rigid 4mm telescopes with 12-degree, 30-degree, and 70-degree viewing configurations.

Market research determined that the Olympus OES ELITE 4mm HD Telescopes, Part Numbers WA2T412A, WA2T430A, and WA2T470A, meet the Government's minimum functional requirements for this acquisition. The requested telescopes provide the required 12-degree, 30-degree, and 70-degree viewing configurations and are designed for full compatibility with the existing Olympus OES Pro System. The requested telescopes are being acquired to replace the existing Olympus telescopes currently used as the core component of the cystoscopy trays. The existing telescopes are well past EOL, and many have been bent over years of use and can no longer be inserted into the resection piece without potential damage to the scope and potential harm to patients.

Although market research identified other manufacturers offering 4mm rigid surgical telescopes with similar viewing angles, the identified products are not the exact OES ELITE products requested by the Government. The Government's existing equipment is configured around the Olympus OES Pro System, and the OES ELITE telescopes are designed for full compatibility with that system. The identified alternative products therefore do not establish that they can serve as direct replacements for the existing Olympus telescopes within the Government's current configuration. The Government's requirement is to replace the existing telescopes while maintaining the current equipment configuration used by the Urology Section and avoiding replacement or modification of existing system components. Any determination that an alternative manufacturer's telescope cannot meet this requirement should be supported by the technical evaluation of Urology/Clinical Engineering.

The exact requested models are WA2T412A, WA2T430A, and WA2T470A. The acquisition includes

Acquisition ID#: 36C250-26-AP-0482 seventeen (17) of each telescope configuration and the trade-in of seventeen (17) existing 12-degree, 30-degree, and 70-degree telescopes.

The Nonmanufacturer Rule (NMR) applies to this procurement under NAICS 339112, and the SBA has not provided a waiver. Market research determined that the VA and SBA Rule of Two could not be met, as no two certified SDVOSB/VOSB vendors were identified capable of meeting the Government's requirement. Accordingly, this procurement is recommended to proceed as a sole-source acquisition to Olympus America, Inc. under FSS Contract No. 36F79721D0168.
