SECTION I: Introduction

The Transportation Security Administration (TSA), Security Operations (SO) and Contracting and Procurement propose to solicit and issue a purchase order based on soliciting only one source. (FAR 13.106-1 (b)(2))

The procurement request number is PR246100B015 and the Contracting and Procurement’s tracking number is JA- '2024'-05-1043

This acquisition is conducted under FAR Part 13, Simplified Acquisition Procedures.

SECTION II: Description of Action Being Approved This requirement is for Preventive Maintenance Visit needed for the simulators at the FFDO Recurrent Training Center, Dallas, Texas. A firm fixed price purchase order will be issued to Newton Design in the amount of $7,238.29 The anticipated period of performance will be from April 26, 2024 through June 25, 2024.

TSA-FFDO purchased the simulators from Newton Design and they have been providing the preventive maintenance to be used for conducting the Recurrent training for the Federal Flight Deck Officers (FFDOs).

SECTION III: Description of Supplies or Services

Preventative Maintenance needed for the B737 and B767 cockpit simulators used during FFDO Recurrent Training at the Dallas RTP Training Center. The Preventative Maintenance Visit will include:

• 2 Technicians from Newton Design LLC, Catoosa, OK to work on the maintenance needed for the simulators up to 2 days.

• Travel Costs

Tasks to be performed:

• 8 Cockpit cameras to be replaced by self-focusing cameras.

• Panel above captain’s seat in the 767 has come lose and is hanging down and needs to be fixed or replaced.

• Sprinkler heads have come loose in both the 737 and 767 cockpits and needs to be fixed or replaced.

• A Jump seat has come loose in the 767 cockpit and needs to be fixed or replaced.

• Cabin speaker on the 767 cockpit is inoperable and needs to be fixed or replaced.

• The chaotic lighting in Platform 4 is not functioning and needs to be fixed or replaced.

• The fan in the ECQ cockpit simulator (223986) is not working and needs to be fixed or replaced.

• One of the smoke generators in Platform 4 can only be utilized manually at the unit not from the control board. The smoke generator needs to be fixed to work from the control board.

• There is also some trim coming loose from Platform 4 and exposing sharp corners. The trim needs to be fixed or replaced.

SECTION IV: Identification of the Single Source Justification

FAR 13.106-1(b) Only one source is capable of responding due to the unique or specialized nature of the work.

Brand Name Only

An urgent and compelling need exists and soliciting more than one vendor would result in unacceptable delays.

A licensing agreement is required as a part of this purchase order, which is available from only one source.

SECTION V: Description of Rationale Newton Design, LLC (26015 E ADMIRAL PL CATOOSA, OKLAHOMA 74015-5743) is the Original Equipment Manufacturer (OEM) of all Aircraft Cabin Training Simulators (ACTS) and equipment used in all of the TSA/ Federal Flight Deck Officer (FFDO) Recurrent Training Centers. Newton Design, LLC obtained the original contracts through competitive procurements and they were found to be vastly superior in construction and cost competitiveness. The ACTS contain proprietary configuration details that are specific to the FAMS training program. Newton Design delivered the simulators to the Dallas Training Center and have been providing the preventive maintenance used for training purposes for FFDOs to complete their Recurrent Training Requirements.

SECTION VI: Contracting Officer’s Determination that the Order Represents the Best Value The contracting officer will determine that the anticipated price will be fair and reasonable based on similar previous purchases TSA previously awarded. The aircraft simulators were competitively purchased for both the Federal Air Marshal Service and the Federal Flight Deck Officer program. Several orders have been placed with Newton Design since the initial awards in 2013 for maintenance and repairs and prices will be compared to historical pricing.

SECTION VII: Market Research Description Market research was conducted using several internet searches:

2. The Mandatory Strategic Sourcing Contracts

3. Small Business Administration Website

4. The World-Wide Web

5. Thomas Register

The searches did not find any vendors that can provide the preventive maintenance services for the cockpit simulators that were originally supplied by Newton Design LLC. The Aircraft simulators are proprietary to Newton Design and third parties are not authorized to provide maintenance due to the warranty of the simulators. Only one responsible source is capable of meeting the Government’s needs.
