About this file
This is a Justification and Approval (J&A) document for a sole source procurement by the Naval Facilities Engineering Systems Command Southeast (NAVFAC SE) for liquefied natural gas (LNG) supply and delivery to Naval Station Guantanamo Bay (NSGB), Cuba.
The procurement is a sole source purchase order awarded to Phoenix Contracting LLC (located at 9915 Smarty Jones Dr., Ruskin, FL 33573) under the authority of 10 U.S.C. 3204(a)(2) for unusual and compelling urgency. The requirement involves delivery of approximately 150,000 MMBtu of LNG across three scheduled deliveries: 50,000 MMBtu on April 27–May 1, 2026; 50,000 MMBtu on May 18–22, 2026; and 50,000 MMBtu on June 8–12, 2026. The LNG is needed to power a Combined Cycle Power Plant (CCPP) at NSGB. The contract is funded by FY26 Operations & Maintenance Navy funds, with performance anticipated through June 12, 2026.
The justification for sole source award centers on the critical need for U.S. Flag vessel availability. The prior LNG contract expired April 10, 2026, and the new competitive contract (N6945026D0015) is currently under a Stop Work Order due to a GAO protest by the incumbent contractor, Schuyler Line Navigation Company (SLNC), with a decision expected July 15, 2026. The document emphasizes that Phoenix is the only identified source capable of meeting the urgent requirement with available U.S. Flag vessel capacity. A previous competitive solicitation (N69450-26-R-PW01) issued November 4, 2025, received four offers and was awarded to Excelerate Gas Marketing, Limited Partnership (LPTA offeror), but remains halted pending GAO resolution. The Contracting Officer determined pricing fair and reasonable through comparison with historical U.S. Flag vessel pricing, competitive solicitation pricing, and independent Government estimate.

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government for the requirements covered by this J&A are fair and reasonable in accordance with FAR 15.404-1(b)(1), (2) and (5). The Government compared pricing to historical prices paid for U.S. Flag vessels, competitive U.S. Flag vessel pricing under the competitive solicitation, and the independent Government estimate to negotiate a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition. The new contract, pending a decision by the GAO, was competitively solicited on an unrestricted, full and open basis. Following the GAO decision, the command will take all reasonable measures to proceed as expeditiously as possible to prevent any additional sole source contract actions. There are currently no further actions required to remove barriers to future competition.
