About this file

This document is a Sole Source Justification for a simplified acquisition under FAR Part 13.501(a)(1)(ii). The Office of Acquisition Management proposes to award a purchase order to MOI on the basis of other than full and open competition for punchlist ancillary furniture at the U.S. Embassy in Tegucigalpa, Honduras, at a total estimated cost of $91,214.61. The requirement is to provide furniture that matches the existing MOI-provided ancillary furniture installed under a prior competitively-bid contract, PO# 19AQMM22F7608, in order to maintain consistent design intent and reduce future maintenance and storage costs. The Contracting Officer has determined that MOI is uniquely qualified to meet this need, as no other manufacturers can produce the exact same furniture in the required finishes. The Contracting Officer also determined that the anticipated price will be fair and reasonable based on the previous competitive pricing. This sole source award is being made under the authority of 41 U.S.C. 1901 or 41 U.S.C. 1903.

SOLE SOURCE JUSTIFICATION FOR SIMPLFIED ACQUISITIONS

FAR Part 13.501(a)(1)(ii)

1. Identification of the agency and the contracting activity:

In accordance with Federal Acquisition Regulation (FAR) 13.501(a)(1) in accordance with 41 U.S.C. 1901 or the authority of 41 U.S.C. 1903, the Office of Acquisition Management proposes to award a purchase order to MOI on the basis of other than full and open competition for punchlist ancillary furniture at the U.S. Embassy in Tegucigalpa on behalf of OBO/PDCS/DE/ID to match PO# 19AQMM22F7608. The total estimated cost is $91,214.61.

2. The nature and/or description of the action being approved.

Award new contract to MOI for punchlist ancillary furniture to be installed in the US.

Embassy Tegucigalpa. The order requires the punchlist ancillary furniture to match the existing ordered and installed for the NEC in 2022/2023 with PO# 19AQMM22F7608.

This will allow OBO/PDCS/DE/ID to accomplish consistent design intent throughout the entire compound. This also reduces Post’s costs in the future as trying to maintain more than one base of furniture product in the Embassy increases maintenance costs and storage requirements.

3. A description of the supplies or services required to meet the Department’s needs.

The requirement is to provide punchlist ancillary furniture at US Embassy in Tegucigalpa, at a total cost of $91,214.61. This will allow the Office of OBO/PDCS/DE/ID to accomplish consistent design intent by maintaining an embedded base of product and match existing ancillary furniture. The sole source justification is to match

19AQMM22F7608.

4. An identification of the statutory authority permitting other than full and open competition:

In accordance with Federal Acquisition Regulation (FAR) 13.501(a)(1) in accordance with 41 U.S.C. 1901 or the authority of 41 U.S.C. 1903.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the action require use of the authority cited.

The Contracting Office determines that MOI is uniquely capable of meeting this need. The existing building currently has competitively-bid MOI-provided ancillary furniture installed and no other manufacturers are able to make the exact same furniture in the same finishes.

6. A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable, include whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

The Contracting Office determines that no other vendor is able to meet this need because the existing building currently has competitively-bid MOI-provided ancillary furniture installed and no other manufacturers can make the exact same furniture in the same finishes.

7. A determination by the contracting officer that the anticipated cost to the

Government will be fair and reasonable. Note: dollar amounts may not exceed statutory limitations for the commercial items test program identified in FAR

13.500.

The Contracting Office determines that the anticipated price(s) will be fair and reasonable based on competitively-bid pricing. By signing the justification, the Contracting Officer makes a determination that the cost/price to the Government are expected to be fair and reasonable.

8. A description of the market research conducted (per FAR Part 10) and the results or a statement of the reason market research was not conducted.

Market research was not conducted because no other vendor is able to meet this specific need.

9. Any other facts supporting the use of other than full and open competition such as:

The building has existing ancillary furniture per 19AQMM22F7608, and this new order is seeking to order replacement or additional furniture in outstanding sections to match the rest of the building.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

N/A

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition before any subsequent acquisition for the supplies or services required.
