About this file

This is a Bid Instructions and Specifications document issued by the State of Maine for the establishment of a one-year contract for lithium batteries (sizes AA and AAA) to be stocked in the State's Central Warehouse for distribution to using State Agencies. The contract period runs approximately from April 1, 2013, through March 31, 2014, with the State reserving the right to renew the contract for two additional one-year increments, provided pricing and contract terms remain in the State's best interest. Vendors are required to bid only on lithium batteries packaged in units of eight batteries per pack, with approved brands being Energizer Advanced Lithium, Energizer Ultimate Lithium, and Duracell Ultra Lithium. Other equivalent lithium battery brands require testing and evaluation through the University of Southern Maine Materials Testing Unit at the vendor's expense. The estimated yearly value of the contract is unknown; however, historical usage data indicates annual consumption of approximately 4,602 packs of 12 alkaline AA batteries and 1,840 packs of 12 alkaline AAA batteries, though lithium batteries are expected to serve as an alternative rather than a direct replacement. All bids must include detailed packaging information and expiration dates on each battery.

Pricing shall be net, inclusive of transportation and delivery charges on standard packages, with all costs fully prepaid by the contractor on an F.O.B. Destination basis. There is no set minimum order requirement throughout the contract, and vendors must accept the State of Maine Procurement Card as payment with no surcharges allowed. Deliveries must be completed within ten days of order receipt and shipped on 40 x 48 non-exchangeable pallets or in cardboard boxes. Vendors must contact Michelle Kirk at the Central Warehouse with shipping confirmation and schedule pallet deliveries 24 hours in advance. The State is exempt from federal excise taxes and state sales taxes, with exemption certificates available upon request. Contractors are required to furnish detailed purchase summaries annually or upon request and for any contract extension. The Division of Purchases retains the right to cancel the contract with thirty days' written notice or immediately if terms and conditions are not met. For battery testing, a deposit of one-half the estimated test cost is required prior to testing at the bidder's expense, with testing charged at $140 per hour with a one-hour minimum. Contact for the procurement is Todd Cummings, Buyer II, at todd.cummings@maine.gov or (207) 624-7336.
