About this file

This is a Sole Source Procurement Request (Form 24-103-205, C.R.S.) submitted by the Colorado State Patrol, Division of ITD, for the procurement of a Performance Based Brake Tester (PBBT) from LINK Engineering. The requested equipment is a specialized in-ground brake testing machine designed to measure braking performance on commercial vehicles certified for use within the Commercial Vehicle Safety Alliance (CVSA) inspection process. The Model 14200 unit will be installed at the Fort Collins Scale and Port of Entry with full in-ground, outdoor installation funded through ITD grant monies. The project was previously approved as a sole source procurement in July 2024 but is being resubmitted to reflect changed circumstances including a relocated installation site, revised cost allocations between Colorado State Patrol and Colorado Department of Transportation, and increased maintenance frequency from annual to twice-annual service based on industry best practices for in-ground scale systems.

The estimated total procurement cost is $176,902, comprised of $99,496 for goods and $77,406 for services. LINK Engineering is the sole vendor capable of providing an in-ground PBBT machine suitable for outdoor deployment at a Port of Entry, as it is the only model on the market with no above-ground components susceptible to truck strikes and with specifications compatible with very low-profile vehicles. The price quoted is reasonable based on market research and historical comparison to a competing mobile PBBT unit priced at $191,928 in 2022 by the only other North American manufacturer (VIS), which does not produce in-ground outdoor-rated equipment. The procurement has been posted on the VSS electronic procurement system under NPSS1 number RBAA 2027*008. A Statement of Work with full specifications and bid pricing has been attached to support this request.

A sole source procurement is justified when there is only one good or service that can reasonably meet the need and there is only one vendor who can provide the good or service. A requirement for a particular proprietary item (i.e., a brand name specification) does not justify a sole source procurement if there is more than one potential bidder or offeror for that item. Note: All sole source requests will be posted on an electronic procurement system in accordance with §24-106-103(5) C.R.S.

Procured Goods Response:
Description of Goods/Services: Performance Based Brake Testers are highly specialized machines used to measure brakes on Commercial Vehicles. They can be certified for use within the CVSA inspection process. They enable inspection of vehicles more efficiently, and provide a way to measure brakes on units not accessible to inspectors without a pit (for instance car haulers and certain models of tractor are too low for an inspector to access roadside.) As a pilot project, a PBBT with full in-ground, outdoor installation is being installed with ITD grant monies at the Fort Collins SB Port of Entry. The model 14200 by LINK is fully in ground with no components susceptible to truck strike, and suitable for outdoor deployment. This model is the only one on the market that meets these metrics.
Description of Goods/Services #2: There are only two companies which make / install/ Distribute PBBT machines in North America. One, VIS, does Mobile PBBT's for CSP on a

sole source basis. VIS does not make an in-ground machine with the qualities above - suitable for outdoor installation, no above-ground components, etc. LINK is the only machine suitable for POE installation, both for durability, and for concerns such as truck strikes and other problems created by an aboveground component directly adjacent to the measuring device / scale lane.

Start Date:
End Date:
G3 Text Bpx: This Sole Source Request replaces a similar request made and approved 7/2024. The project was delayed due to an opportunity to align this project more closely with the needs and strengths of our CDOT partners - which has moved the location, and more clearly delineated ownership of the engineering and site preparation duties. From the Expired Sole Source, The costs for the goods have decreased, with CDOT preferring to choose location and provide engineering. The costs for extended service have increased - as POE staff prefer twice-annual manufacturers service based on their experience with newer in-ground scale systems launched in the past 6 years. The observations of POE on a best practices maintenance cycle are valuable. The previous PO called for a single visit each year.

The previous Sole Source resulted in the execution of PO RBAA_202500003351. The vendor has taken certain good faith steps toward completing this work, prior to the change of location, based on the existence of this PO. Three things things are true - This Sole Source and PO must be changed to reflect the current Statement of Work. The reasons this PO was awarded as Sole Source have not changed. The vendor will be harmed if we VOID the PO, rather than amend it to fit the new circumstances.

G1 Text Bpx: I would rely on the expertise of the CSP procurement team to develop an approach that has the smallest / fastest footprint and also meets Code requirements. I do not anticipate any sort of posting or RFP would change the outcome of the procurement, as PBBT technology is provided by such a limited number of vendors, but it may impact the timeline of the project.
F1 Text Bpx: This machine, by this vendor, is the only offering on the market that will be suitable for an

outdoor deployment at a POE. It has no above-ground components, and no ramps, or other pieces which would interfere with measuring brakes on very low trucks, or removal of snow.

The technical aspects of the offered machine have been thoroughly reviewed by nationally recognized PBBT Subject Matter Experts within the Operational Services Branch (Greninger and Thomas). The Machine as offered meets the functional requirements to be incorporated into the inspection program, and in addition to the below-ground installation required for safe operation at a POE, has several advantages in width and roller size for effective use on a variety of vehicle configurations. The SOW with full specifications are attached, as well as a bid price.

E4 Text Box: There is only one vendor for the equipment. The costs were in line with the market research / prices offered before the grant was written. Further, the price quoted for the single fixed unit, with warranty and extended maintenance, is less than the mobile unit, warranty, and no defined maintenance agreement priced for CSP in 2022 (191,928.00). Again, the company (VIS) which provides the Mobile units cannot provide the fixed unit with qualities for permanent POE installation. The quote is included to further flesh the claim that the proposal by LINK is at market rate.
