About this file

This is a Limited Sources Justification (LSJ) form documenting a sole-source acquisition by the United States Patent and Trademark Office (USPTO). The USPTO intends to award a hybrid firm-fixed-price/labor-hour GSA Federal Supply Schedule order to Precision Receivable Services LLC (GSA FSS Contract #47QRAA23D009N) for Personal Assistance Services (PAS). The estimated contract value is redacted. The Contracting Officer is Andrew Spinazzola, and the acquisition package number is ACQ-26-0723. The procurement is justified under GSAR 538.7104-3 based on unusual urgency, as the USPTO requires immediate PAS to support employees with targeted disabilities who have returned to headquarters.

The justification cites legal requirements under Section 501 of the Rehabilitation Act and the Equal Employment Opportunity Commission Final Rule (29 C.F.R. § 1614.203), which mandate provision of PAS. The sole-source award is limited to a six-month bridge period until a long-term competitive Blanket Purchase Agreement can be finalized. Market research conducted on January 6, 2026, identified multiple qualified GSA schedule holders, but Precision Receivable Services LLC was the only vendor that responded with the necessary information and capability to meet the urgent timeframe. The acquisition seeks to prevent a lapse in service coverage that would violate federal law and impair employee ability to perform official duties. Technical and Contracting Officer certifications have been completed; Office of General Law Counsel review was not required as the action value is below $10 million.

SECTION I. COMPLETED BY THE PROGRAM OFFICE

United States Patent and Trademark Office (USPTO) Office of the Chief Financial Officer (OCFO) Office of Procurement (OP) Alexandria, VA

The USPTO Office of Procurement (OP) intends to negotiate and award a hybrid firm-fixed-price / labor-hour GSA Federal Supply Schedule (FSS) order to Precision Receivable Services LLC for Personal Assistance Services (PAS)

The USPTO requires Personal Assistance Services (PAS) for employees who, due to targeted disabilities, require assistance during work hours or on job-related travel. These services are a legal mandate; failure to provide them constitutes a violation of the Agency’s obligations under federal law.

Section 501 of the Rehabilitation Act prohibits Federal agencies from discriminating against individuals with disabilities in employment. It requires agencies to engage in affirmative action to promote the hiring, promotion, and retention of individuals with disabilities. Specifically, the Equal Employment Opportunity Commission (EEOC) Final Rule (29 C.F.R. § 1614.203), effective January 3, 2018, explicitly mandates the provision of PAS.

The estimated value to secure immediate service for a six (6) month bridge period until a long-term competitive Blanket Purchase Agreement (BPA) can be awarded will not exceed REDACTED.

FORM USPTO-OP-011.v7.0 (1/2026)

5. Authority and supporting rationale: Authority and supporting rationale (see GSAR 538.7104 and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

6. Description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted

This acquisition is conducted under the authority of the Multiple Award Schedule Program and GSAR 538.7104-3. Consideration of schedule contractors will be restricted to fewer than the number required by GSAR 538.7104-3 [see GSAR 538.7103-2(a)(4), 538.7103-2(b), and 538.7103-3(a)(2)] (i.e., fewer than three FSS contractors).

For orders or BPAs exceeding the micro-purchase threshold (MPT), in accordance with GSAR 538.7104-3, this acquisition is being justified under the following circumstances (Check the appropriate selection)

The need is of such unusual urgency that following the procedures would result in unacceptable delays in fulfilling that need;

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

The order should be issued on a sole source basis in the interest of economy and efficiency because it is a logical follow-on to an FSS order already issued on a competitive basis;

It is necessary to place the order with a particular FSS contractor to satisfy a minimum guarantee established in the FSS BPA; or A law expressly authorizes or requires that the purchase be made from a specified source.

The Agency has an immediate and urgent need to maintain these services to support current USPTO employees. This acquisition serves as a critical bridge to cover the gap between the expiration of the previous PAS award and the award of a new competitive PAS BPA.

The urgency is driven by the following factors:

1. Legal Compliance: The USPTO is legally required to provide these services under 29 C.F.R. § 1614.203 and Section 501 of the Rehabilitation Act of 1973. A lapse in coverage would place the Agency in violation of federal law.

2. Operational Continuity: Employees utilizing these services have returned to the USPTO Headquarters.

Without PAS, these employees cannot perform their official duties or physically navigate the workspace, resulting in a direct negative impact on the Agency’s mission and the employee’s civil rights.

SECTION II. COLLABORATION BETWEEN THE PROGRAM OFFICE AND OP

Market research was conducted to identify GSA schedule holders capable of meeting the PAS requirement.

The Agency reviewed USPTO BPAs, GSA contracts, and historical data.

A search on GSA Advantage identified the following vendors capable of providing PAS:

4. Level above Review (LAR) (see PM 2017-01 for definition) (required for actions at all dollar values except when LAR serves in another review/approval role)

The USPTO is actively procuring a long-term, competitive BPA for Personal Assistance Services that will include a base year and four (4) option years. This competitive package is currently in process. The current sole-source action is strictly limited to a short-term bridge to satisfy the urgent legal and operational need while the competitive procurement is finalized.

Market Research Results: The Agency contacted these vendors to assess their ability to meet the immediate timeline.

Date Inquiries sent: January 6, 2026 Number of Responses received: 1

Despite the outreach to multiple vendors, Precision Receivable Services LLC was the only GSA contract holder that responded with the necessary information and capability to meet the urgent timeframe.

Consequently, they are the only source reasonably available to prevent a lapse in service.
