Exhibit “D” Questions / Answers

Solicitation for Offers LI-14024

1. What is the anticipated vacate date for this request, how long are the apartments needed?

Please refer to Paragraph 7 of the SFO:

“Although the Government plans to lease for an initial period of one (1) year with an option for the Government to renew for one (1) additional period of one (1) year or any portion thereof, the required time frame cannot be firmly established. The Government shall retain the right to terminate each lease in whole or in part at any time, without cause, by giving at least thirty (30) days written notice to the lessor.”

2. What is the ideal apartment size configuration? 4 one bedroom and 1 two bedroom? 3 two bedrooms?

Exact breakdown will be determined by gender composition of the occupants. Females and males will not live in the same unit even if that means some bedrooms in some of the units will not be occupied. For example, if the initial requirement consists of five (5) males and one (1) female, it is anticipated that four (4), two (2) bedroom apartments will be rented.

3. The map attached to the solicitation is very dark and difficult to read the areas where apartments are allowed. Can you either provide a more concise and clearer map?

Please refer to Enclosure 2 to of the SFO. The solid red line, that clearly stands out from all other features of the map, indicates areas where apartments may be located. No additional information will be provided.

4. Some apartment owners say they are bound by the Patriot Act which requires them to conduct background checks of all occupants of apartments. Will the US Government authorize a background check or provide documentation waiving this requirement?

The Government will make an effort to provide the names of the occupants after lease execution for informational purposes of the lessor. However the lease agreement will be with the US Government, who retains the right to move occupants in and out of units as necessary for mission requirements.

5. The Statement of Work, states “The initial request for apartments shall begin on May

1, 2024 for 6 personnel, consisting of up to 4 units.” Are you expecting a mixture of 1, 2 or 3 bedroom apartments to meet this goal? Or is it acceptable to offer (2) 3BR units to lodge the 6 people instead of 4 separate units?

The exact need will be determined by the make-up of the crew, however this is an ongoing requirement that is expected to increase over the solicitation period. All units for which future potential award is desired must be submitted for review by the closing date of this solicitation.

6. How many occupants will rotate in a 12-month lease?

The exact number is unknown, but these are not intended to be short stay accommodations.

They will be housing for crew that is permanently attached to boats in the area.

7. Is a turn clean required between each occupant rotation?

Please refer to Paragraph 12 of Exhibit A.

“The Lessor hereby agrees to perform, upon request by the Government and at no additional cost to the Government, a general cleaning including appliances, furnishings, and professional steam cleaning of all carpeted areas upon termination of a leased unit and/or at a change in assigned occupancy resulting in unit vacancy. Said general cleaning shall occur no more frequently than once per year. Repainting and/or general cleaning shall not be performed upon request of occupants nor without the approval of the Real Estate Contracting Officer.”

8. Is cable required?

No

9. Is a landline telephone required?

10. Will long-term hotels be accepted?

No, apartments are a requirement of the solicitation.

11. Will the government commit to 12-month leases?

for the Government to renew for one (1) additional period of one (1) year or any portion thereof, the required time frame cannot be firmly established. The Government shall retain

12. Will the government pay for unoccupied units?

Yes, payment is not tied to occupancy. For example, there may be periods during the lease term that a unit remains unoccupied due to occupant turnover for which the government would still pay for the unit until the new occupant moves in. So long as the government has leased the unit, the government will pay for it, whether it is occupied or not, pursuant to the lease terms.

13. Will the government consider giving a 60-day notice, as this is the industry standard?

14. Will one bedrooms be accepted, or only 2 and 3 bedrooms?

No, only 2 and 3 bedroom apartments are needed for this requirement.

15. How long is the initial stay, will each reservation/rotation be a year long?

for the Government to renew for one (1) additional period of one (1) year or any portion thereof, the required time frame cannot be firmly established. The Government shall retain

16. Do you know if the housing for the initial 6 units is already in place in another contract and if they are moving over from another contract? In other words, is that ship part way through its progress of work or is it just beginning work on the ship around May 1?

This is a new requirement.

17. The contract is May 1, 2024 - May 1, 2026 for various units. If units are contracted for starting on May 1, 2025, will this be for a two -year period ending on May 1, 2027? If units are contracted starting on April 30, 2026, will these be for 2 years ending on April 30, 2028? Will I be pricing out units through May 1, 2026 or through May 1, 2028?

Please note that the dates have been updated. Please refer to Paragraph 7 of the SFO:

for the Government to renew for one (1) additional period of one (1) year or any portion thereof, the required time frame cannot be firmly established.”

Leases will only be executed under this SFO until December 1, 2026. A follow-on SFO will be released for additional units after that time period. The initial time period will only be for one year as stated above. Pricing should be provided as outlined in Enclosure 1, Offer Form.

18. Regarding Notice ID LI-14024, I understand that 30 personnel need housing. Will fifteen 2-bedroom apartments work?

The solicitation allows for two (2) bedroom and three (3) bedroom units. The current need as outlined in the solicitation is for housing for six (6) personnel consisting of up to four (4) units, which may expand up to thirty (30) personnel during the solicitation period.

19. How much notice will be given before the apartment needs to be occupied, as time is needed to secure the unit and set up the furniture and supplies. 1 month, 2 months. 3 months? Do you have the time schedule of manning up of the boat?

As additional units are needed during the requirement period, a request for availability will be emailed to all previously awarded lessors approximately 2 months prior to the need commencing. Notice of acceptance of new units will be done approximately 1 month prior proposed occupancy.

20. Since only 6 need housing immediately and not the entire 30, should I submit my bid just for 6?

Yes, the initial requirement is 6 personnel, consisting of up to 4 units. However, future requirements for the remaining personnel will be awarded under this solicitation as well. All complexes that offerors desire to be considered for future award must be submitted for approval under this solicitation by the closing date in order to be eligible for future award under the solicitation. The remaining beds will be awarded by sending requests for availability to the awardees of this solicitation, as outlined in question 19 above.

21. Since the award will be based on a per bedroom rate can you explain the rationale behind the agency wanting 2 & 3 bedroom options versus 1 bedroom options?

This is an improper question as it does not ask a question that helps an offeror submit an acceptable proposal.

22. On Amendment 2 it states "a min of 5 units, or the full requirement of availability request, whichever is less, located at the same complex." All other documents still state 4 units. Can you clarify how many units total are being sought for initial lease?

The full requirement for the initial leasing effort is anticipated to be approximately 4 units.

As this is less than 5, all units must be located within the same complex. However, for a complex to be considered for further award under this solicitation, it must be submitted for initial award. After award is made under this solicitation, a follow-on request for updated availability will be released to awardees with the lowest priced units, as availability in the apartment market can change rapidly.

23. Will the base GSA rate be applicable per person or per unit? If not, is there a set rate for the contract period?

There is no base GSA rate for this contract. It is not applicable on a per person or per unit basis. There is no set rate for the contract period. The purpose of this solicitation is for the offeror to submit pricing for all periods as described in the solicitation. Award will be made based on lowest priced, technically acceptable units, as outlined in the solicitation.

24. If I have more than one complex that fits the requirements AND has multiple units per complex available, should I submit a quote for each complex with the requested information or just choose one complex for this submission at this time?

Each offeror should submit any and all complexes for which they wish to be able to receive any current or future awards from this solicitation. There is no limit to how many complexes may be submitted by an offeror under this solicitation. Complexes that do not currently have 4 vacant units may still be submitted, as vacancy will change throughout the period of the solicitation. As additional requirements are identified under this solicitation, requests for availability will be sent to the awarded lessors in the order of lowest priced to highest priced until the future requirement is fulfilled. This solicitation will result in a list of awarded unit types at awarded complexes with set prices which will be used when conducting further requests for availability under this solicitation.

25. You need 4 units for 6 personnel on first time but later when you need the rest of the units for the 24 others personnel, if we don't have against units, the contract will be withdraw from the company?

No, as additional units are required, a follow-on request for availability will be released to all previously awarded lessors for the units and complexes that have been approved under this SFO. A follow-on request for availability and award will not affect any previously executed leases.

26. How interchangeable is ADA compliance with UFAS compliance in your eyes? I understand UFAS is about accessibility in hallways and entrances and is less stringent than ADA. Would you disqualify a property on the UFAS factor if it were not ADA compliant?

No, a property will not be disqualified based on ADA compliance. UFAS compliance is a requirement of the SFO.

27. We are in the process of getting a cage code and not sure if we will have it in time for the final bid. Will our bid be accepted if we do not have a cage code by the 16th?

Yes, we will accept the bid, but lease award cannot be made until the CAGE Code is received. If award is made prior to receipt of the CAGE Code, we will not be able to make award and the lessor would be passed over for this round of requirement of the SFO.
