Solicitation Questions and Answers

Q1: Is there any minimum requirement for M/WBE, S/D/LBE, SDVOB participation? (Attachment J-5 is not included.)

Are there Small Business targets in place for this contract, and if so are they mandatory for compliance?

A1: Small Business Subcontracting Goals/Targets:

o Service-disabled veteran-owned small business: 1.25% o Veteran-owned small business: 2% o HUBZone small business: 3% o Small disadvantaged business: 5% o Women-owned small business: 5%

These represent goals. Meeting or exceeding these goals will weigh favorably on the technical evaluation of the “Small Business Subcontracting Plan” criteria. Attachment J-5 is to be proposed by the offeror in accordance with FAR Clause 52.219-9 (referenced on page 16 of Exhibit J-1 FRA General Terms and Conditions for Services) if the subcontract exceeds $700,000 and the offeror is not a small business and there are sub-subcontracting possibilities.

Q2: Is the PM required to be an Illinois PE?

A2: No, but the report and any supporting calculations shall be prepared under the direct supervision of a PE or SE registered in the State of Illinois.

Q3: If any meetings or work required more than what specified in the RFP, the hours will be compensated as Time and Material? Do we need to provide hourly rate of our staff?

A3: This is a traditional lump sum Firm-Fixed-Price. Submission of hourly rates in addition to the FFP is not required.

Q4: Per G3.2, invoicing structured by each SLIN and is only permitted upon completion delivery and acceptance of all required deliverables. What is the basis for acceptance? If the deliverables do not get accepted, additional meeting other than specified in the RFP are required? Please clarify if those meetings need to be in-person or teleconference?

A4: Acceptance criteria is completeness and compliance with the SOW. Additional meetings for the subcontractor’s benefit in delivering a complete review in compliance with the SOW will be at the subcontractor’s cost.

Q5: Is there any minimum criteria for varying levels of Key personnel? None are listed in H8 or Attachment J-3 Section 2.2.

A5: None other than they are qualified for the work undertaken. Refer to Attachment J-3, Section 4.3. Per Section L, Paragraph L1, the proposed discipline leads for the team will be evaluated for selection based upon experience and technical merit.

Q6: Does NTP only apply to SLIN #1? Per H10, funds are only available for SLIN #1 and funding for SLIN #2 is contingent upon availability of funds.

A6: Per B3 and H10, the subcontractor will receive written notice from FRA that SLIN #2 has been funded.

Q7: If the schedule for SLIN #2 is extended, will the fixed fee be renegotiated or subject to escalation?

A7: The schedule for SLIN #2 starts with the meeting approximately one month prior to receipt of design documents and goes through the meeting approximately one week after delivering comments. SLIN #2 is expected to be performed in late

2021. Offerors should price SLIN #2 accordingly. The FFP will not be renegotiated or subject to escalation. In the event of an excessive delay in providing the Final Design documents to the subcontractor for review, FRA may entertain a request for equitable adjustment.

Q8: Attachment J-3, section 2-Scope of Services refer to “identify risks to the design” as an area of focus for the independent review. Is a risk register expected to be developed? Risk assessment as well?

A8: Any risks identified shall be tabulated or otherwise compiled and characterized. This is intended to be a qualitative assessment based on the reviewer’s subject matter expertise to alert FRA of potentially unforeseen risks stemming from the technical nature of the design. Comments representing risks shall be ranked Low, Medium, or High per J-3 Section 4.2.

Q9: Will other independent review finalized deliverables within the program be available for reference?

A9: No other independent design reviews of the LBNF main scope have been performed. The project has only recently begun preliminary design.

Q10: Will the basis of design report be available prior to the initial design submission?

A10: All 50% and 100% Preliminary Design submission documents will be available prior to the start of the independent design review.

Q11: What is the anticipated cost of construction?

A11: The anticipated cost of construction is greater than $200M and less than $500M.

Q12: Attachment J-3, Section 4.3-Report, states that “The report shall be sealed by a professional engineer or structural engineer registered in the State of Illinois indicating that the report and any supporting calculations were prepared by or under the direct supervision of a licensed professional engineer or structural engineer for each discipline”. Does this mean each discipline should be prepared by or under the direct supervision of an Illinois PE or any other PE is enough?

A12: The intent is for the work to be performed by or under the direct supervision of Illinois-registered professional engineers.

Q13: Page 3 of 5 of the Scope of Work states, “Does the design of the water barrier system meet objectives?” Can any additional detail on these objectives be defined at this time?

A13: The fundamental requirement is to prevent the exchange of water between the shielding concrete and the environment.

Due to the facility’s long service life (50 years), it is essential that the performance of the design be verifiable and maintainable.

Q14: Have maximum allowable groundwater infiltration and/or outward leakage rates been defined (e.g., at the Decay Region, Absorber Hall/Muon Shielding and Near Detector Hall)?

A14: No. The IDR subcontractor shall evaluate any assumptions presented as part of the Preliminary Design.

Q15: Are secondary waterproofing elements, such as post-remedial grout injection ports or re-groutable hoses for construction joint leak remediation anticipated?

A15: None anticipated but potentially acceptable.

Q16: Are there any subsurface environmental soil and/or groundwater investigations available or is it anticipated that such studies would be made available to the peer reviewer?

A16: None beyond what was furnished with the geotechnical data report submitted with the RFP.

Q17: Is any site-specific data on physical, chemical resistance or longevity testing of the geosynthetic components available or is it anticipated that such data reports would be made available to the peer reviewer?

A17: No, no such studies have been performed.

Q18: Will the design include working, phasing or construction sequence drawings for the geomembrane installation?

A18: None anticipated.

Q19: Section L – Instructions, Conditions and Notices to Offerors – this states that: “L10. EXCEPTIONS: FRA warns Offerors that taking exceptions to any term or condition of this RFP (including submitting any alternate proposals that requires relaxation of a requirement) may make an offer unacceptable, and the offeror ineligible for award. If exceptions are taken, Offerors shall identify the Section or Attachment of the RFP and paragraph or clause designation which the Offeror is taking exception to. The reason for any exception(s) shall be clearly stated in the Offeror’s proposal.

Substantive exceptions may cause your offer to not be accepted.” However, we would like to check if it is possible to change the following paragraph to the following:

Section J-1, FRA General Terms and Conditions for Services June 2019 – Clause 6.1. Indemnification:

“The Subcontractor shall indemnify and hold harmless FRA, The University of Chicago, Universities Research Association, Inc., and the United States Government, their officers, agents, servants, and employees from any and all liability for losses, expenses, damages, demands, and claims, and shall defend any claim, suit, or action brought against any or all of them based on any alleged personal injury or property damage, and shall pay any damages, costs, and expenses, including attorneys’ fees, in connection with or resulting from such claim, suit, or action that to the proportionate extent they arise in whole or in part from:

Subcontractor’s breach of any term or provision of the subcontract documents, or any negligent or willful act or omission of the Subcontractor, its employees, agents, of subcontractors, material suppliers, or anyone for whose acts they may be liable, regardless of whether such liability, claim, damage, loss, penalty, forfeiture, fine, or suit is caused in part by a party indemnified hereunder.”

A19: Exceptions can only be reviewed in the context of a complete proposal. If exceptions are taken, Offerors shall identify the Section or Attachment of the RFP and paragraph or clause designation which the Offeror is taking exception to. The reason for any exception(s) shall be clearly stated in the Offeror’s proposal. Substantive exceptions may cause your offer to not be accepted.

Q20: Is it possible to verify the number of designers that submitted a proposal for the A/E preliminary design?

A20: No.

Q21: Can you clarify how many reports, drawings, specifications, and other document need to be reviewed by the independent reviewer at the preliminary and final design review period?

A21: 100% Preliminary Design Drawings, Specifications, and Design Report.

Q22: Is there any page limit to the proposal?

A22: No

Q23: Section 4.3 indicates that the report may include calculations. Can any further detail be provided for this? Are detailed calculation reviews anticipated as part of the review?

A23: No

Q24: What is the scope associated with calculations? It is assumed any calculations will be minor/simple in order to provide a sanity check of the design or basis for a comment on the design. Detailed calculations are not anticipated as part of the review.

A24: Correct assumption

Q25: In person meetings – these are assumed to be at the Fermi Labs office in Illinois, please confirm.

A25: Yes – any required in-person meetings will be held at Fermilab.

Q26: Schedule: The RFP gives the performance period for SLIN 1 of 2/1/20 to 4/30/20. Attachment J-3, Independent Design Review Statement of Work states that 100% Preliminary Design will be completed in April 2020, and that the review period is 4 weeks. Will the 100% Preliminary Design be available at the beginning of April, allowing completion of the review as per the stated schedule for SLIN 1, or will the stated schedule be adjusted to accommodate the review period following completion of the 100% Preliminary Design?

A26: We currently expect the 100% Preliminary Design Drawings and Specifications to be completed by March 31, 2020 and available immediately following in early April. The schedule will be adjusted to allow the review four weeks to be completed following delivery of the 100% Preliminary Design drawings and specifications.

Q27: The proposal states “The Offeror shall provide resumes of the individuals proposed for the Offeror’s project team.

The Offeror proposes to perform the duties and responsibilities of the required Senior Construction Manager position at the construction site in Lead, South Dakota” which is described in the Statement of Work. Please clarify this requirement.

A27: This language was deleted and replaced with the correct language in Amendment 1.

Q28: Based on the design currently contemplated what is the total sheet count for drawings?

A28: 600

Q29: Number of Specifications?

A29: 200

Q30: To avoid any conflict of interest, what company is performing the design work that will be reviewed?

A30: AECOM Technical Services, Inc.

Q31: Section L1.1 " the Offeror proposes to perform the duties and responsibilities of the required Senior Construction Manager." We assume this does not apply to this contract, please confirm.

A31: This language was deleted and replaced with the correct language in Amendment 1.

Q32: Section L1.1 Technical Evaluation Criteria. Do we need an ESH Plan & Safety Record for a desk study such as this contract?

A32: A project specific ESH Plan is not required. A corporate ESH Plan and Safety Record is requested to evaluate the technical qualifications of the offeror.

Q33: Section B – describes the contract as “Firm-Fixed-Price” is this equivalent to a traditional lump sum or more similar to a T&M with a cap which is the "Firm-Fixed-Price". A follow-on question would then be, do we need to submit hourly rates in addition to the Firm-fixed-price?

A33: This is a traditional lump sum Firm-Fixed-Price. Submission of hourly rates in addition to the FFP is not required.

Q34: Do you anticipate an interview prior to award of the contract?

A34: No

All other terms and conditions remain unchanged.
