Executive Office for Immigration Review (EOIR) Public Resources and Communications Division, Office of Policy
Request for Information
Purpose:
This Request for Information is to determine whether there are interested, capable, and qualified organizations in the marketplace with the knowledge, skills, qualifications, capacity, and capability to meet the Government’s obligations to provide immigration legal services under the Settlement Agreement in Ms. L., et al. v. ICE, et al., 18-cv- 00428-DMS-AHG (S.D. Cal. Oct. 16, 2023). The Government seeks to identify entities with the existing qualifications to provide legal advice on immigration matters, prepare individuals for immigration interviews and court hearings, complete immigration-related documents (including applications for asylum, parole, and employment authorization), and mentor volunteer legal representatives. The specific services that the Government seeks are specified in the attached draft Statement of Work (SOW), “Legal Access Services for Reunified Families Program.”
Background:
In 2018, a class action lawsuit was filed against the Government on behalf of certain families who were separated from each other at the United States border with Mexico.
On December 12, 2023, the United States District Court for the Southern District of California granted final approval of a Settlement Agreement between the parties. The Settlement Agreement requires the Executive Office for Immigration Review (EOIR), which provides immigration court proceedings, appellate reviews, and administrative hearings, to offer legal access and orientation services to Settlement Class members and qualifying additional family members.1 The Public Resources and Communications Division, housed within EOIR’s Office of Policy, oversees the immigration legal services outlined in the Settlement Agreement.
Objectives:
The Government anticipates that a single award contract or multiple award contracts will be issued with a period of performance of one year with the potential for additional option years. The applicable North American Industry Classification System (NAICS) code is 541110. This is a market survey for informational purposes only and shall not be construed as a Request for Quote (RFQ). The draft SOW attached to this Request for Information is included solely to help vendors prepare responses to this market survey.
No awards will be made based on this announcement, no reimbursement will be made for costs associated with responding to this announcement, and no telephone calls or other communications about this announcement will be accepted or acknowledged.
Information Sought:
1 The definition of a Ms. L. Settlement Class member can be found in Section II of the Settlement Agreement. The definition of a Qualifying Additional Family Member can be found in Section I(L) of the Settlement Agreement. The Settlement Agreement is attached.
Interested, capable, and qualified businesses responding to this Request for Information are requested to respond to the following questions:
1. What are common pricing structures for the services specified in the SOW?
2. Are you a small business?2
3. What is a typical staffing strategy, and what is your pricing structure for personnel? Please note any experience your organization has staffing programs that provide services in languages other than English.
4. Would the work require the use of subcontractors? If so, what percentage of work would be completed by the prime versus subcontractors? How do you ensure background checks and corresponding credentials/licensures are completed and tracked if subcontractors are providing the required services?
5. What is your ability to provide the program services required by the draft SOW?
In your answer, please explain your ability to provide the required services remotely and in-person to individuals located across the United States.
6. If you do not have the ability to provide the required services across multiple locations/regions, where would you be able to provide the required services?
7. What are your capabilities to fulfill all of the requirements in the draft SOW? In your response, please include relevant examples of your organization’s experience as a prime contractor or subcontractor, including the customer name, period of performance, contract type, contract number, contract value, a description of work performed relevant to the draft SOW, and your organization’s role (i.e., prime contractor or subcontractor).
8. How will you ensure that the legal advice offered to Settlement Class members and Qualifying Additional Family Members through this program is complete, accurate, and competent?
9. How will you ensure that program services are provided in a timely fashion, knowing that many Class members and Qualifying Additional Family Members are subject to strict application deadlines?
10. Is there any other information the Government should know or consider in developing a solicitation for the required services?
2 In order for the Government to assess set-aside possibilities under the NAICS code specified above, please identify if you are a small business. Status as a small business concern is determined in accordance with 13 CFR Part 121.108. Please refer to FAR Part 19 at www.acquisition.gov, for additional detailed information.
