About this file

This is the Citrus County Land Development Code (LDC), an ordinance adopted by Citrus County, Florida, establishing comprehensive regulations for land use, development, and code enforcement within the county's unincorporated areas. The document serves as the primary implementation tool for the Citrus County Comprehensive Plan and is codified under Chapter 163, Part II, Florida Statutes, and Chapter 125, Florida Statutes. The LDC establishes administrative procedures, definitions, development review processes, and enforcement mechanisms applicable to all development occurring after the ordinance's effective date. Key administrative officials designated include the Director of Growth Management, Building Official, Director of the Land Development Division, Director of the Department of Public Works, and Director of the Department of Water Resources, each with specified duties regarding development review, permitting, and code compliance. The Planning and Development Commission (PDC) is established as a seven-member body (plus two alternates and one non-voting School Board representative) responsible for reviewing development applications, making recommendations on the Comprehensive Plan, and rendering decisions on specific development proposals in accordance with established criteria.

The LDC contains extensive definitions of land use terms, development standards, and procedural requirements governing residential, commercial, industrial, and extractive uses throughout Citrus County. Enforcement of the LDC is administered through the Code Compliance Division, with violations subject to multiple remedies including referral to a Code Compliance Special Master appointed pursuant to Chapter 162, Florida Statutes, citation procedures, permit withholding or denial, revocation of approvals, stop work orders, civil actions, and consent orders. The document establishes an appeals process for applicant and interested parties to challenge decisions made by the Board of County Commissioners or PDC, with appeals of official interpretations directed to the Growth Management Director within thirty days and appeals of variances or conditional uses filed as Petitions for Writ of Certiorari with the Circuit Court within thirty days. The ordinance reflects the county's commitment to guiding coordinated development, protecting natural resources and public welfare, controlling growth intensity, and maintaining stability across residential, agricultural, business, industrial, and recreational areas.

C. Mandatory concept review allows property owners to modify proposals in response to early staff comment;

D. All administrative decisions should be supported by a record with written findings to assure accountability and efficient appellate review;

E. A quick, efficient, and nonpolitical avenue of appeal should be available for all ministerial and administrative decisions; and

F. Enforcement of development orders and the provisions of this LDC should be through procedures that are efficient, effective, and consistent with code enforcement procedures established by State law.

1300. PURPOSE AND INTENT

H. Balancing the interest of the general public in Citrus County and that of individual property owners;

I. Protecting, and where necessary, preserving our valuable natural resources including, but not limited to: ecologically significant land, water resources, wildlife habitat, fisheries, and threatened or endangered species; and
