Contractor will be responsible for submitting a written request for reimbursement of the amount of the OCP policy premium invoice less all such charges including surplus lines taxes and other incidental fees. The Contractor shall contact the Louisiana Department of Insurance, ldi.la.gov, to receive additional guidance.
Contractor must also submit an original sworn affidavit from the insurance producer/agent in which that person attests that the submitted invoice is for the required OCP coverage only, and that the invoice accurately reports the cost to contractor of that coverage. The invoice and affidavit may be submitted at the preconstruction conference or thereafter for inclusion with a partial estimate.
There will be no reimbursement for any purchase of OCP insurance policy extensions necessitated by concurrent; non-excusable; or excusable, non-compensable delays in completion of the project, whenever such delays occur, or for claimed utility delays where such days were not added to Contract Time by change order. Any policy extensions necessitated by excusable, compensable delays will be reimbursed on a pro-rata monthly basis.

S.P. STANDARD MANATEE CONDITIONS
FOR IN-WATER ACTIVITIES (01-26)
Subsection 107.9 of the 2026 Louisiana Standard Specifications for Roads and Bridges is amended to include the following:
107.9.010 STANDARD MANATEE CONDITIONS FOR IN-WATER ACTIVITIES
During in-water work in areas that potentially support manatees, instruct all personnel associated with the project about the potential presence of manatees, manatee speed zones, and the need to avoid collisions with and injury to manatees. Advise all personnel that there are civil and criminal penalties for harming, harassing, or killing manatees which are protected under the Marine Mammal Protection Act of 1972 and the Endangered Species Act of 1973. Additionally, instruct personnel not to attempt to feed or otherwise interact with the animal, although passively taking pictures or video would be acceptable.
All on-site personnel are responsible for observing water-related activities for the presence of manatee(s). To minimize potential impacts to manatees in areas of their potential presence:
a) Cease all work, equipment, and vessel operation if a manatee is spotted within a 50-foot radius (buffer zone) of the active work area. Once the manatee has left the buffer zone on its own accord (manatees must not be herded or harassed into leaving), or after 30 minutes have passed without additional sightings of manatee(s) in the buffer zone, inwater work can resume under careful observation for manatee(s).
b) If a manatee is sighted in or near the project area, operate all vessels associated with the project at “no wake/idle” speeds within the construction area and at all times while in waters where the draft of the vessel provides less than a four-foot clearance from the bottom. Vessels shall follow routes of deep water whenever possible.
c) If used, siltation or turbidity barriers shall be properly secured, made of material in which manatees cannot become entangled, and monitored to avoid manatee entrapment or impeding their movement.
d) Post temporary signs concerning manatees prior to and during all in-water project activities and remove upon completion. Each vessel involved in construction activities shall display at the vessel control station or in a prominent location, visible to all employees operating the vessel, a temporary sign at least 8 1/2 x 11 inch reading language similar to the following: “CAUTION BOATERS: MANATEE AREA/ IDLE SPEED
IS REQUIRED IN CONSTRUCTION AREA AND WHERE THERE IS LESS THAN FOUR
FOOT BOTTOM CLEARANCE WHEN MANATEE IS PRESENT”. A second temporary sign measuring 8 1/2 x 11 inch shall be posted at a location prominently visible to all personnel engaged in water-related activities and shall read language similar to the following: “CAUTION: MANATEE AREA/ EQUIPMENT MUST BE SHUTDOWN
IMMEDIATELY IF A MANATEE COMES WITHIN 50 FEET OF OPERATION”.
D-19
e) Immediately report collisions with, injury to, or sightings of manatees to the U.S. Fish & Wildlife Service’s Louisiana Ecological Services Field Office (337) 291-3100, the Louisiana Department of Wildlife and Fisheries, Wildlife Diversity Program (504) 286- 4052 or 1-800-442-2511, and the DOTD Environmental Section at (225) 242-4502.
Provide the nature of the call (i.e., report of an incident, manatee sighting, etc.); time of incident/sighting; and the approximate location, including the latitude and longitude coordinates, if possible.

S.P. ENVIRONMENTAL PROTECTION (01-26):
107.14 of the 2026 Louisiana Standard Specifications for Roads and Bridges is deleted and replaced with the following:
107.14 ENVIRONMENTAL PROTECTION
Comply with federal, state and local laws and regulations controlling pollution of the environment, including air, water and noise. Take precautions to prevent pollution of waters and wetlands with fuels, oils, asphalts, chemicals, or other harmful materials and to prevent pollution of the atmosphere from particulate and gaseous matter. Attention is directed to Section 204, Temporary Erosion Control.
Certify under penalty of law the understanding of and agreement to abide by the terms and conditions of the Storm Water Pollution Prevention Plan (SWPPP) and the Louisiana Pollution Discharge Elimination System (LPDES) General Permit. LPDES General Permit requires the discharges from construction sites be managed to prevent pollutants from entering waters of the United States in accordance with the Environmental Protection Agency's (EPA) regulations for storm water discharges with respect to 33 U.S.C. § 1342 (Sections 402 (p) and 405 of Public Law 100-4).
The use of erosion control features or methods other than those in the contract shall be as directed by the engineer.
Construction operations in rivers, streams, lakes, tidal waters, reservoirs, canals, and other impoundments are restricted to areas where it is necessary to perform filling or excavation to accomplish the work and areas which must be entered to construct temporary or permanent structures. Operations in navigable waters, wetlands, or other waters of the United States require permits. Responsible to ensure all appropriate permits are obtained prior to commencement of operations. As soon as conditions permit, streams and impoundments shall be cleared of temporary obstructions placed therein or caused by construction operations.
Frequent fording of streams with construction equipment will not be permitted.
No residue from dust collectors or washers shall be dumped into a stream. Attention is further directed to the federal, state, and local air pollution control programs and their rules and regulations regarding air pollution, especially open burning, fugitive dust and asphalt concrete plant restrictions.
Maintain and operate equipment to minimize noise and vibration as well as comply with local noise ordinances. Engines shall be equipped with properly functioning mufflers. Assure the activities near noise and vibration sensitive areas, such as churches, hospitals, and schools are not unduly disruptive.
The Master Notice of Intent (NOI) will be submitted by the Department to the Louisiana Department of Environmental Quality (LDEQ) at the end of each 5 year permit cycle of the Louisiana Pollution Discharge Elimination System (LPDES) Statewide Permit (LAR 600000) and
D-21 prior to project letting under the new permit cycle. The monthly Project List will be completed and submitted by the Department to the LDEQ by the 15th of each month, in accordance with the terms of the permit.
The Contractor will develop and post a site specific Storm Water Pollution Prevention Plan (SWPPP) for each project in accordance with the Master SWPPP Template provided to the Contractor by the Department. The Department ensures the posting of the SWPPP at the project site by the Contractor and that all site activities conform to the terms of the LPDES Statewide Permit (LAR 600000) and the Master SWPPP.
The Storm Water Pollution Prevention Plan shall be comprised of Section 204 of the standard specifications along with applicable supplemental specifications and special provisions, and Standard Plan EC-01, "Temporary Erosion Control Details."

S.P. DETERMINATION AND EXTENSION
OF CONTRACT TIME (CALENDAR DAY) (05-26):
Subsection 108.7, Determination and Extension of Contract Time, is amended to include the following:
The contractor shall document for each month of scheduled construction, the occurrence of adverse weather conditions having an impact on controlling items of work. An adverse weather day is a previously scheduled or normally scheduled work day on which rainfall, wet conditions or cold weather will prevent construction operations on the controlling work activity from proceeding for at least 5 continuous hours of the day or 65 percent of the normal work day, whichever is greater, with the normal working force engaged in performing the controlling item of work. If the contractor submits a written request for additional contract time due to adverse weather conditions, the contractor’s request will be considered only after the Department agrees with the days and then only for adverse weather days in excess of the allowable number of days per month stated below. Adverse weather days will be documented by the Engineer and agreed upon monthly. Adverse weather days will be prorated for partial months when a work order or final inspection is issued other than the first or last of the month and agreed to by the Department. If the contractor is being considered for disqualification by the Department, an equitable adjustment in contract time may be made at the end of the original contract period, including all days added by approved change orders. Contract time will be adjusted by comparing the actual number of adverse weather days to the statistical number of adverse weather days over the specific time period per the table below. The resulting number of adverse weather days will be multiplied by 1.4 to convert to calendar days. Adjustments for adverse weather cannot result in a contract time reduction. Once adjusted, a new adverse weather day accounting will begin using the adverse weather conditions having an impact on the controlling items of work, in excess of the allowable number of days per month stated below. A second and final contract time adjustment will then be done at the final acceptance of the project. An adjustment in the contract time due to adverse weather will not be cause for an adjustment in the contract amount. There will be no direct or indirect cost reimbursement for excess adverse weather days.
D-24
The following are anticipated adverse weather days that the contractor shall include in each month of his calendar day construction schedule.
January 10 days May 5 days September 4 days
February 9 days June 6 days October 3 days
March 8 days July 6 days November 7 days
April 7 days August 5 days December 7 days
