About this file

This is a Labor and Material Payment Bond form issued by the County of Orange, California, required as a contractual obligation for the Passenger Survey Services for Tracking and Data procurement at John Wayne Airport. The bond ensures that the selected contractor will pay all suppliers, workers, and service providers involved in contract performance. The bond amount must equal or exceed the estimated contract value, and the contractor must obtain surety authorization from a company licensed to conduct business in California. Bidders were required to submit electronic bids through the County's eProcurement Portal by April 3, 2026, at 4:00 p.m. The contract structure includes a three-year initial term with two optional one-year renewal periods awarded on a firm-fixed-fee basis to the lowest responsive, responsible bidder. Upon contract award, the selected contractor must provide the completed Labor and Material Payment Bond within seven days of notification, along with a corresponding Faithful Performance Bond and certificates of insurance.

The bond serves as security covering all labor, materials, provisions, supplies, equipment, and machinery used in contract performance, as well as amounts due under California's Unemployment Insurance Code. The surety is obligated to pay claims not exceeding the bond's penal sum and must reimburse the County for costs, reasonable expenses, and attorney fees incurred in enforcing the bond obligation. The bond inures to the benefit of all claimants eligible to file under California Civil Code Section 9100 and covers employment-related tax withholdings. Corporate signatories must comply with California Corporations Code Section 313 requirements, which specify that either two authorized officers or a single officer with documented authority must execute the bond. The bond remains in effect regardless of any changes, extensions, or modifications to the underlying contract terms, specifications, or work scope.
