About this file

This is a Labor and Material Payment Bond form issued by the County of Orange, California, establishing the bonding requirements for contractors awarded county contracts. The bond serves as a financial guarantee that the contractor and any subcontractors will pay for all materials, supplies, labor, and services used in performing contracted work, as well as comply with unemployment insurance obligations under California Civil Code sections 9550 et seq. The bond amount must equal or exceed the estimated contract value, and the penal sum is to be determined based on the specific contract awarded. The bond inures to the benefit of all claimants eligible to file claims under California Civil Code Section 9100, including material suppliers, laborers, and subcontractors. The bond obligates the surety to pay claim amounts up to the bond limit, plus all costs, expenses, and reasonable attorneys' fees incurred by the County in successfully enforcing the obligation.

The surety executing the bond must be duly authorized to transact business under California law, and both the contractor and surety must execute the document with proper corporate authority as specified in California Corporations Code section 313, requiring either two authorized officers or one officer with written evidence of binding authority. The bond terms specify that no changes, extensions, alterations, or additions to the contract terms, work scope, or specifications shall affect the surety's obligations, and the surety waives notice of any such modifications. The bond document requires approval from both the County's Risk Management and CEO Office and the Office of the County Counsel prior to execution. This bonding requirement is standard for public works contracts awarded by Orange County and applies to the Specialty Laboratory Analysis Services contract opportunity with an electronic bid deadline of February 12, 2026, at 2:00 PM.
