About this file

This is a Faithful Performance Bond document issued by the County of Orange, California, establishing bonding requirements for contractors entering into agreements with the county. The bond serves as a guarantee that the principal contractor will faithfully perform all covenants, conditions, and agreements specified in the underlying contract. The document establishes a penal sum amount (to be filled in based on the specific contract) that represents the financial obligation jointly and severally binding the contractor and surety to the county. The bond remains in full force unless the contractor performs all required work in accordance with contract specifications, timelines, and terms. Any modifications, extensions, or alterations to the underlying contract do not affect the surety's obligations, and the surety waives notice of such changes.

The bond requires a notarized signature from the surety representative with a certificate of notarization attached, and the surety company name must be typed or stamped above the signature line. The county must approve the surety and bond limits through the CEO/Risk Management office and approve the bond form through the Office of County Counsel. The premium charged on the bond is calculated at a specified rate per thousand dollars of the contract price. The document incorporates California Corporations Code section 313 requirements for corporate signatories, permitting either two authorized officers (with specific designations) or a single officer with documented authority to bind the corporation. The county retains the right to recover all costs, reasonable expenses, and fees incurred in enforcing the bond obligation, which shall be taxed as costs and included in any judgment rendered.
