About this file

This is a Labor and Material Payment Bond form required by the County of Orange, California, for contractors awarded contracts by the County. The bond is mandated under California Civil Code Sections 9550 et seq. and serves as a financial guarantee that the contractor and subcontractors will pay for all materials, labor, equipment, and supplies used in contract performance. The bond amount must equal or exceed the estimated amount payable under the contract. The bond protects all claimants eligible to file claims under California Civil Code Section 9100, including material suppliers, laborers, and subcontractors. The surety agrees that no changes, extensions, or alterations to the contract terms or specifications will affect its obligations, and it waives notice of such changes. In case of suit, the surety must pay the bond face amount plus costs, reasonable expenses, and attorneys' fees incurred by the County in enforcing the obligation.

The bond requires execution by the contractor as principal and a California-authorized surety company acting jointly and severally. Approval authority rests with the County's Office of the County Counsel and the CEO/Risk Management division. For corporate contractors, execution must comply with California Corporations Code Section 313, requiring either signatures from two authorized officers in specified roles or a single officer signature supported by corporate resolution documentation. The bond inures to the benefit of all persons and entities entitled to file claims and specifically covers employment-related deductions and withheld amounts payable to the Employment Development Department under the Unemployment Insurance Code.
