About this file
This is a Labor and Material Payment Bond form issued by the County of Orange, California, which serves as a required financial guarantee for contractors awarded public works contracts. The bond ensures that contractors will pay for all materials, labor, equipment, and supplies used in the performance of their contract work, as well as fulfill employment-related obligations. Contractors are required to furnish this bond in accordance with California Civil Code Sections 9550 et seq. The bond must be executed by the contractor as principal and a state-authorized surety company, with the penal sum set at not less than the estimated amount payable under the contract terms. The document requires signatures from authorized corporate officers of both the contractor and surety, as well as approval from the County's CEO/Risk Management and County Counsel offices.
The bond obligates the surety to pay claims from any materials suppliers, laborers, equipment providers, or subcontractors who are not paid by the contractor, up to the bond's penal sum. The surety also agrees to cover any amounts required to be withheld and paid to the Employment Development Department under California's Unemployment Insurance Code. In the event of litigation, the surety is responsible for paying the County's costs, reasonable expenses, and attorney's fees incurred in enforcing the bond obligation. The bond inures to the benefit of all persons and entities entitled to file claims under California Civil Code Section 9100, providing them direct recourse against the bond. The surety waives notice of any changes, extensions, alterations, or additions to the contract terms or specifications, remaining fully obligated regardless of such modifications.
