About this file

This Labor and Material Payment Bond document is issued by the County of Orange, California, as a surety bond requirement for contractors awarded work under County contracts. The bond ensures that the contractor, along with the surety company, will pay for all materials, labor, supplies, equipment, and related costs used in performing the contracted work. The bond amount must equal at least the estimated total contract value payable by the County. The specific contract referenced in this bond pertains to the supply and delivery of rubber stamps, pads, daters, engraving, and related items for the Sheriff-Coroner Department. The contract is established for an initial three-year term commencing June 29, 2026, with two optional one-year renewal periods subject to mutual written agreement and County Board of Supervisors approval. Bids were required to be submitted electronically through the County's eProcurement Portal with a deadline of March 9, 2026, at 4:00 p.m. The awarded contract will be established on a firm fixed pricing basis with delivery required within ten working days of order placement to 28 specified Orange County facilities.

The bond serves as protection for all claimants entitled to file claims under California Civil Code Section 9100, including laborers, material suppliers, and subcontractors. In the event of contractor default, the surety agrees to pay claims up to the bond's penal sum and will also cover any costs, reasonable expenses, attorneys' fees, and court costs incurred by the County in enforcing the bond obligation. The bond contains a waiver clause stipulating that no changes, extensions, alterations, or additions to the contract terms or specifications will affect the surety's obligations. The bond document requires execution by authorized corporate officers in compliance with California Corporations Code Section 313, with approval as to form by the Orange County Office of County Counsel and approval as to surety and limits by the County's CEO/Risk Management office. Pricing for the contract includes a five percent preference deduction for certified Orange County Local Small Business or Disabled Veteran Business Enterprise vendors, and an eight percent deduction for businesses certified as both, with contractor pricing guaranteed to be equal to or less than that offered to other government entities.
