About this file
This is a Labor and Material Payment Bond document issued by the County of Orange, California, required for a Calibration & Certification of Gas Sniffers contract under California Civil Code Sections 9550 et seq. The bond serves as security for the contractor to ensure payment for all materials, supplies, labor, equipment, and services used in performing work under the contract. The contractor must obtain this bond from a surety company authorized to conduct business in California, with the bond amount set at not less than the estimated amount payable by the County under the contract terms. The bond inures to the benefit of all persons, companies, and corporations entitled to file claims under California Civil Code Section 9100, including laborers, materialmen, and suppliers. The bond also covers any amounts required to be withheld and paid to the Employment Development Department for employee wages under the Unemployment Insurance Code. The contract runs for five calendar years beginning April 18, 2026, with services provided on an as-needed basis for eight pump stations throughout Orange County.
The bond obligates the surety to pay claims up to the penal sum if the contractor fails to pay for materials, labor, or other supplies related to the contract performance. Should the County pursue legal action to enforce the bond, the surety is liable for costs, reasonable expenses, and attorney fees as determined and taxed by the court. Per California Corporations Code Section 313, the contractor's corporate signature authority must comply with specific signing requirements, either through dual officer signatures (chairman, president, or vice president alongside secretary, assistant secretary, chief financial officer, or assistant treasurer) or a single authorized officer with supporting corporate resolution documentation. The total aggregate contract amount for the five-year term is not to exceed $200,000, with pricing based on hourly rates for onsite calibration, field repairs, and facility repairs, plus replacement parts billed at cost without markup. The bid submission deadline is December 2, 2025, at 2:00 pm, and the County offers preference to local small businesses and disabled veteran business enterprises.
