The RFP L15PS00247 was cancelled and replaced by this RFP.
The Government intends to award a multiple award
Indefinite Delivery Indefinite
Quantity(IDIQ)contract resulting from this solicitation.
It will be awarded to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
This is a 100% Small Business Set Aside. Since this is a Small Business Set Aside, more than 50% of the performance must be performed by the prime on each task order.
The contract will be for one year with 4 twelve month options. The firm fixed price delivery orders will consist of the items outlined in the schedule of items in Section B in accordance with the terms and conditions set forth in this solicitation.
Delivery orders will be issued as funding becomes available.
The minimum contract guarantee will be awarded concurrently with the IDIQ contract. The minimum contract guarantee does not guarantee each multiple awardee to receive an award.
Please offer on each line item you want to be considered for an award. You must indicate your unit price based on the estimated five year quantities indicated in Section B, Schedule of
Items, for all five years.
This is a firm fixed priced (FFP)contract with economic price adjustment (EPA). Progress

FORBS (ANNUAL AND PERENNIAL)
Group A - Seed Price1: Species in this group are annual or perennial grasses and forbs that meet the following criteria: species are generally easy to cultivate. Previous cultivation histories are available, generally predictable seed yields that are modest to good, and require standard harvesting techniques. Under Item B above, all grass seed produced is paid at this rate.
Group A species examples include, but not limited to: Western Yarrow (Achillea millefolium), Rocky Mountain beeplant (Cleome serrulata), Lewis Flax (Linum lewisii), Nettleleaf giant hyssop (Agastache urticifolia), annual sun flower (Helianthus annuus), Bluefield gilia (Gilia capitata), hoary tansyaster (Dieteria canescens), Douglas' dustymaiden (Chaenactis douglasii). All grasses.
Group B - Seed Price2: Species in this group are perennials that meet one or more of the following criteria: species are generally difficult to cultivate because there is little or no previous cultivation history; species require more than one year to produce a seed crop, unpredictable seed yields or seed yields that are low or may require multiple harvests or unorthodox harvest techniques.

SECTION C - STATEMENT OF WORK
1.0 GENERAL
1.1 Introduction – The Bureau of Land Management (BLM) and other federal land management agencies have a long-term need to supply native plant materials for federal land management rehabilitation and restoration efforts. Common uses for native grass and forb seed include: wildfire rehabilitation and stabilization needs, revegetation of roads, construction sites and other developments, mitigating erosion and sediment movement into streams, habitat improvement projects, and the control and prevention of further spread of invasive plant species.
1.2 Scope – The object of this contract is to increase small amounts of wildland collected seed into larger seed quantities for re-vegetation projects on federal land. Seed ordered under this contract will be used by the BLM, Bureau of Indian Affairs (BIA), U.S. Fish and Wildlife Service (FWS), National Park Service (NPS), Natural Resources Conservation Service (NRCS) and U.S. Forest Service (USFS) within the states of Alaska, Arizona, California, Colorado, Idaho, Montana, Nevada, New Mexico, Oregon, Utah, Washington, and Wyoming. All seed delivered to the Government shall be source identified (SI) certified native seed under the AOSCA certification program for Pre-Variety Germplasm (PVG) according to the requirements herein. All seed will be delivered to locations within the states named above.
2.0 DEFINITIONS
Association of Official Seed Analysts, Inc. (AOSA) - An organization of official state, federal, and university seed laboratories in the United States and Canada with the purpose of establishing Rules for Testing Seeds, achieving standardization among analysts and laboratories. Association of Official Seed Certifying Agencies (AOSCA) - An international organization that develops certification requirements and standards that accommodate plant germplasm (whether newly acquired accessions or named varieties) of native grasses, forbs, and woody plants. These certification procedures provide third-party verification of source, genetic identity, and genetic purity of wildland collected or field or nursery grown plant germplasm materials. Container Production – This is the technique of sowing seed, germinating, and growing plants in cells or containers prior to transplanting in the field, usually in a controlled environment.
The steps usually ensure increased levels of seed germination, plant growth and survival in the field.
Contracting officer (CO) - means a person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the contracting officer acting within the limits of their authority as delegated by the contracting officer.
Contracting officer’s representative (COR) - means an individual, designated and authorized in writing by the contracting officer to perform specific technical or administrative functions.
Generation 1 (G1) – The first generation seed produced after wild collection. G0 is wild collected seed; G2 is 2nd generation seed, and so on.
Germplasm Identification Term - An identifying term officially recognized by AOSCA that identifies a specified germplasm in accordance with AOSCA rules for "Nomenclature & Labelling for Plant Germplasm Types", available online at http://seedcert.oregonstate.edu/sourceidentified. For example, the following could serve as a Germplasm ID: ELEL5_2015_BLM_OR030_NBR. This Germplasm ID would provide species name (by code), year of harvest, ordering office, source location (NBR – Northern Basin and Range) International Seed Testing Association (ISTA) - An international organization that develops unbiased and uniform seed testing methods and standards (The ISTA International Rules for Seed Testing). ISTA accredited seed laboratories meet uniform seed testing standards through the Accreditation, Proficiency Test and Auditing Programs. Accredited seed laboratories can be found at: https://www.seedtest.org/en/memberlaboratories.html
Large Lots – A field of 1 ac or more in size of a single species and unique germplasm. .
Minimum Seed Lot Standards - At the time of delivery, the minimum standards for viability, purity, moisture, other crop seed, weed seed and Pure Live Seed for each seed lot of a species.
Native Grass and Forb Seed Accession – Is a collection of seed that represents a species germplasm from a specific area within the project area. A unique seed collection with a single identity and nomenclature.
Noxious Weeds (Federal and State) - The combined lists of prohibited or restricted weeds that occur on any of the federal or state noxious weed lists, in accordance with the Federal Noxious Weed Act of 1974, as amended (7 U.S.C. 2801 et seq.) and the Plant Protection Act (Pub.L. 106–224) in 2000, the Federal Seed Act 7 USC 1551-1611, and the Individual State’s Department of Agriculture seed law and state prohibited and restricted noxious weed control and quarantine lists. Each State maintains official noxious weed lists for seed control and for quarantine of noxious weeds. The lists may be combined.

Pre-Variety Germplasm (PVG) - An AOSCA certification program for plant reproductive material development based upon verification of species and source to facilitate orderly procurement, production, and distribution of plant germplasm materials. Germplasm types include: (1) Source Identified Type (unevaluated germplasm identified only as to species and location of the wild growing parents); (2) Selected Type (germplasm showing promise of desirable traits, having been selected either within or as a common site comparison among accessions or populations of the same species); (3) Tested Type (germplasm for which progeny testing has proven desirable traits to be heritable); finally
(4) Variety/Cultivar release if eligibility requirements are satisfied. AOSCA certification http://seedcert.oregonstate.edu/sourceidentified standards for PVG materials are available at http://seedcert.oregonstate.edu/sourceidentified.NOTE: Since all seed lots under this contract are Source Identified germplasm they are thus unrestricted natural accessions.
Pure Live Seed (PLS) - The percent by weight of viable seed in a seed lot determined after germination and/or Tetrazolium (TZ) tests and purity analysis at a certified lab. PLS is calculated by multiplying a seed lot’s pure seed percent by its viability percent. Any dormant seed is included within the viable seed percentage (i.e., % germination + % dormant seed = % viable seed).
Seed Analysis Report – An official seed quality report issued by the state certified seed testing laboratory for a seed lot. The standard Purity, Germination, TZ report includes seed viability and seed purity, including an all states noxious weed exam. A Crop & Weed Report includes a list of all seed contaminants found in a bulk exam for the crop.
Seed Certifying Agency - A state sanctioned service that develops standards and procedures for certifying crop seed in accordance with AOSCA guidelines. The Seed Certifying Agency in California does not currently have a program for Pre-Variety Germplasm certification.
However, all seed grown under this contract in California shall meet AOSCA Pre-Variety Germplasm certification requirements and standards.
Seed Conditioning - Cleaning and debearding seed by a variety of methods to remove debris, straw material, weed and other undesirable seed and disease organisms (e.g. ergot, smut) and other contaminants.
Seed Quality Standards– Standards established for seed quality of each species that include
1) seed viability minimums, 2) inert matter maximums, 3) pure live seed (PLS) minimums, 4) other crop seed maximums, 5) weed seed maximums, 6) all-states noxious weed seeds, 7) prohibited and restricted weed seeds by individual states. Federal and State prohibited and restricted weed lists can be found at: https://plants.usda.gov/java/noxComposite.
Seed Viability - The amount of live seed, including dormant seed as determined from a germination test or TZ test, whichever is greater. Either test result is acceptable.
Small Lots – a field of less than 1 ac in size of a single species and unique germplasm .
Source Identified (SI) Class – The first step of the Pre-Variety Germplasm natural track.
Unevaluated germplasm identified only as to species with the location of the wild growing parents. Germplasm from a wildland stand with unrestricted representation of the intact wildland plant population on the original site. Genetic manipulation must be purposefully avoided when such accessions are increased in field or nursery production. NOTE: All seed lots under this contract shall be Source Identified germplasm.
Transplant – Manually or mechanically planting container grown plants in the field. A technique used for certain crops to improve the likelihood of survival and the rate of growth during plant development or shorten the period of time until seed production.
3.0 CONTRACTOR-FURNISHED PROPERTY AND SERVICES
3.1 The Contractor shall provide all acreage, labor, supervision, equipment, tools, materials, supplies, facilities, fees, laboratory tests, records, and transportation necessary to cultivate and produce cleaned and tested native seed that meets crop and seed contract quality and quantity standards from species listed in the delivery orders. This includes all field application, seed crop certification and seed testing fees. A fully implemented irrigation system may be required for some species and delivery orders.
3.2 A delivery order may be issued for SI seed that a Contractor has in inventory or for an existing field adequate to meet the delivery order quantity. The crop in production or the existing seed in inventory must meet the requirements of this contract and is subject to CO/COR approval. Payment for seed under this paragraph will be made at the “Subsequent Year Production” price for that species and will not include an Establishment Year Payment under Line item AT.
4.0 GOVERNMENT-FURNISHED PROPERTY AND SERVICES (Also see Section F)
4.1 The Government will provide SI stock seed eligible to meet PVG requirements and standards, and necessary for seed increase to meet quantities stated in the delivery order.
4.2 The Government will provide the eligible stock seed requested and the seed analysis report for the lot to the grower as soon as possible, but not later than August 15 of the sowing year for fall sowing and March 1 for spring sowing. Seed analysis report includes: 1) species, germplasm identification term, source location and year of collection 2) seed viability, pure seed content, inert content, weed and other crops seed content and percent, 3) year tested and testing lab 4) certification Source Identified germplasm tag, if previously certified.
4.3 The Government will provide the field collection data sheet with each germplasm and the Germplasm Identification Term and Generations (Attachment A, Germplasm Identification Term and Generations) required for certification of Source Identified germplasm by the state Seed Certifying Agency. The Government will provide the grower and the state Seed Certifying Agency the following information:
a) The Germplasm Identification Term,
b) Specify a limitation to the number of generations that may be produced for the specified germplasm,
c) Previous generation history of germplasm seed lot when seed provided to the Contractor is G1 or greater (Attachment A, Germplasm Identification Term and Generations).
5.0 SPECIFIC TASKS
5.1 Records
5.1.1 The Contractor shall maintain a record of all field cultural practices by dates for each species in the delivery order. This record shall be provided to the Government upon completion of the delivery order. Such records shall include activities and dates of the following; all agronomic practices, seed sowing, fertilization, fungicide and herbicide treatments, water applications (duration and amount); harvest methods, seed conditioning methods and results, and problems encountered during the growing, harvest and conditioning of the seed.
5.1.2 The seed lot and germplasm identity shall be maintained throughout all phases of the contract. The seed lot identity and nomenclature shall not be lost, mixed, or contaminated with other seed.
5.2 Sowing and Field Management
5.2.1 All fields shall be enrolled in their state seed certification program (except in California) and meet Pre-Variety Germplasm certification requirements and standards in all states. Prior to planting, the Contractor shall be responsible for knowing the AOSCA and state Seed Certifying Agency standards for Pre-Variety Germplasm, including field history, limits on plant volunteers, and crop isolation, and procedures for initiating and completing the seed certification process.
5.2.2 Contractor shall contact the state Seed Certifying Agency in the state where the field will be grown and apply for seedling and seed crop inspection for each field and provide the Agency with the COR name and contact information for each seed lot being increased. All certification standards, requirements, protocols, and time-frames and payment of fees, as specified by the state Seed Certifying Agency of the state where the seed is grown, shall be met. All seed delivered to the Government shall be certified and tagged SI Germplasm, except seed produced in California. All seedling, seed crop and any other field inspection reports, and seed analysis reports shall be submitted to the COR. Seed grown in California will not be required to have AOSCA PVG tags placed on seed bags, but must meet AOSCA PVG requirements and standards.
5.2.3 The Contractor shall perform accepted agronomic and other field cultivation practices necessary to ensure healthy crops and seed production yields to meet seed orders including, but not limited to field cultivation, irrigation, sow seed, fertilizing fields, any necessary applications or cultural methods to control and prevent weeds, pathogens, insects, and rodents, and harvesting the crop at the proper time.
5.2.4 The Contractor shall notify the COR of the initial amount of stock seed required for sowing no later than August 1 for fall sowing or February 15 for spring sowing.
5.2.5 The Contractor shall calculate the amount of stock seed needed for sowing purposes by considering the seed lot viability percent, average seeds per pound, and purity to yield the amounts ordered by the Government (Attachment xx, Table 1, Seed Sowing Rate and Yield Table and Table 2, Grass Seed Quality Standard ).
5.2.6 A Contractor may use existing inventory of PVG SI seed of the species ordered, appropriate to the eco-region and geographic area for seed increase upon approval by the CO/COR. The yield from this crop will first replenish the Contractor-provided seed.
5.2.7 The Contractor shall identify each field or portion of a field with a field marker using either the seed lot code from labels on initial seed lots delivered by the Government, or a germplasm identification number referenced to the seed lot code.
5.2.8 The Contractor shall provide the CO/COR a field map showing the location of all seed lots under cultivation within sixty (60) days of sowing.
5.2.9 The seed increase fields and field records may require periodic inspection by the Government. Access to the fields and records shall be provided by the Contractor. The CO/COR will provide a minimum of three (3) calendar days advance notice.
5.2.10 Initial seed shall be planted on prepared, cultivated land in distinct rows or as allowed by the stated Seed Certifying Agency. The same species shall not have been sown on the same ground within the previous three (3) years for G1, two (2) years for G2, and the previous year for G3.
5.2.11 Noxious weeds, other crops, and off-type plants that are difficult to separate in cleaning shall be rogued prior to field inspection for certification. Failure to rogue may affect certification of the field by the Seed Certifying Agency and acceptance by the Government.
5.2.12 The Contractor shall not take out or plow seed increase fields during the term of the delivery order without prior consent from the COR. Failure to obtain prior permission may affect past performance rating during the technical evaluation in placement of future delivery orders.
5.2.13 The Contractor shall manage seed increase fields in such conditions so that the species genetic purity is maintained. Any condition that indicates possible contamination of the germplasm or does not allow adequate isolation to maintain genetic purity may be cause for rejection.
5.2.14 When stock seed provided to the Contractor is G1 or greater, the Government will provide (see Attachment xx Germplasm Identification Term and Generations). In addition, the number of generations allowed of perennial grass and forb species shall be no more than fourth generation (G4), removed from wild collected seed. The number of generations allowed for annual grass and forb species shall be no more than third generation (G3), removed from wild collected seed.
5.2.15 Under Line items A1 and A2, the Contractor shall sow stock seed in containers and grow container stock for out-planting. The Contractor shall determine the proper container size and quantities, sowing rate, growth period and other agricultural practices for optimum growth and transplanting survival based on the species type, growth characteristics, and transplanting technique employed.
5.2.16 Under Line item A3, the Contractor shall transplant container stock to the field, either manually of mechanically, at the proper time to ensure optimal survival. Standard industry handling practices shall apply to ensure transplant stock does not desiccate or mold before transplanting.
5.3 Seed lot Isolation Standards - All cross-pollinated and self-pollinated seed lots shall be separated by the isolation standards described in the state certification handbook to maintain genetic purity. Other methods are allowed to meet seed lot isolation standards under the state certification handbook, such as border removal, but may affect the number of generations allowed. Fields grown in California shall meet AOSCA Pre-Variety Germplasm Certification Standards.
5.4 Harvesting the Crop
5.4.1 The State Seed Certifying Agency and CO/COR shall be notified of the approximate date of harvest so that scheduling of field certification can be arranged, except in California.
5.4.2 Seed shall be harvested at the proper time as conditions allow and placed in storage.
5.4.3 The CO/COR shall be notified within three (3) days if weather conditions do not permit harvesting.
5.5 Seed Quality Standards
5.5.1 All seed shall be conditioned to meet standards for pure seed, other crop, inert and weed seed, and to, include debearding of awns, if desirable and necessary.
5.5.2 After conditioning, a seed sample of each lot considered for certification must be drawn for testing. Drawing seed samples for testing shall follow procedures specified by AOSA, the state Seed Certifying Agency, or State Seed Law.
5.5.3 The Contractor shall arrange with the state Seed Certifying Agency to have seed samples submitted for testing at an official state seed testing laboratory or any ISTA accredited seed testing laboratories, and to arrange for an original seed analysis report to be provided directly to the CO/COR by the official seed testing laboratory. The following seed tests are required for all lots:
a) Purity
b) Viability test (germination or TZ test)
c) Weed test (including all-states noxious weed analysis)
d) Crop and weed test
Seed moisture test may be required when visual examination indicates that seed moisture content appears to be above 11%.
5.5.4 The seed produced shall meet minimum PLS: viability; purity; seed moisture; other crop;
weed seed standards, as shown, by species in Attachment xx, Table 2, Grass Seed Quality Standard and Table 3, Forb Species - Seed Quality Standards and the requirements in 5.5.5, 5.5.6, 5.5.7 and 5.5.8. Other native plant seeds that originated with the original wild collection may be excluded from the other crop and weed seed maximums in the seed analysis report for acceptance purposes. However, in the official seed analysis report and in determining eligibility for PVG tagging, such seeds may be counted as Other Crop or Weed Seeds. TZ tests may be substituted for germination test.
5.5.5 For grass and forb species not listed in Attachment xx, Table 2, Grass Seed Quality Standard and Table 3, Forb Species - Seed Quality Standards or listed in the Delivery order, the following seed lot standards shall apply:
a) Seed Viability minimum 60%
b) Inert Matter maximum 30%
c) Other Crop Seeds maximum 0.15%
d) Weed Seeds maximum 0.10%
5.5.6 Other Undesirable Weed Seed Standards
No more than one seed each (one seed found in testing and reported as the actual number found, not converted to #/lb.) is allowed when reported in the Crop & Weed Seed exam or reported under the Purity and All State Noxious Weed Seed portions of a standard Purity exam for the following species:

Any seed lots not meeting any of these standards will:
a) Be rejected and require reconditioning at Contractor expense to meet seed quality standards, or
b) Purchased at the Government’s discretion at a reduced rate (see Section H, Paragraph 1.1.7).
5.5.7 Seed lots shall contain no seed of prohibited or restricted noxious weed seeds listed under the Federal Seed Act or by individual State’s Department of Agriculture seed law. Official Federal and State lists of noxious weed seeds may be accessed at:

5.5.8 Seed lots shall contain no noxious weeds listed on state noxious weed list categories identified here: prohibited, regulated and restricted weeds in Arizona; noxious weeds in Alaska, Nevada, Idaho, Wyoming, and Utah; A,B, Quarantine and Temporary weeds in California; A&B weeds in Colorado and New Mexico; Category 1&2 weeds in Montana; A,B, Quarantine and Noxious weed Oregon; A,B, Quarantine and Noxious Weed Seed and Quarantine weeds in Washington.

5.5.9 Seed must be conditioned, sampled, tagged, and stored at a warehouse approved by the state Seed Certifying Agency to handle certified seed.
5.5.10 An incentive payment will be made for all seed lots that contain no seed of the species listed in the current "All States Noxious-Weed Seed Requirements” in the seed analysis report and no seeds of other undesirable weed seeds of species listed in 5.565. (See Section H Paragraph 1.1.6).
5.5.11 An incentive payment will be made for all seed lots when weed seed exam amounts in the weed seed category of the analysis report are 50% or less of the maximum allowable weed seed content. (See Section H Paragraph 1.1.6).
5.6 Seed Storage
5.6.1 Grass seed shall not be allowed to become wet after harvest.
5.6.2 Seed shall be stored in a building, shed or warehouse that allows air circulation and is protected from rain, moisture, and rodents or other conditions that would reduce the viability of the seed.

1.0 Seed Packing
1.0.1 All processing and bagging of seed shall be completed within one hundred fifty (150) days of harvest.
1.0.2 Conditioned grass seed shall be packaged in new sacks meeting specification listed below:
Standard Poly, Cotton, or Heavy Paper Sacks Style: Sewn bottom, open mouth Type: Triple-ply, poly-lined, heavy duty paper Size: As needed to insure that bags weigh less than 60 lbs.
1.1 Seed Bag Labeling
1.1.1 All bags shall be tagged and labeled to meet state seed law labeling requirements. All bags shall be tagged with a state certifying agency's certification tag for Source Identified seed (yellow tag), except for lots grown in California. In all states the label shall contain:
a. Name and address of the Contractor, or commercial grower;
b. Species name and germplasm identification term and number that corresponds to seed analysis report;
c. Seed Test Results - purity, viability, other crop seed, weed seed, inert content, and test date;
d. Bag weight;
e. Federal contracting ordering office name, contract number, and delivery order number.

SECTION E - INSPECTION AND ACCEPTANCE
1.0 Inspection
1.0.1 The state Seed Certifying Agency will inspect all fields to certify acceptance of proper field management at Contractor expense, except for fields grown in California. The COR or designated official shall inspect the fields in California to ensure compliance with AOSCA Pre- Variety Germplasm certification standards. The certification unit is the entire field as defined in the Certification Handbook. If the Contractor fails to register or the fields fail to comply with the state Seed Certifying Agency and AOSCA Pre-Variety Germplasm certification standards in California, the seed may be
a) Rejected, or
b) Purchased at the Government’s discretion at a reduced rate per (see Section H, Paragraph1.1.7.)
1.0.2 The CO/COR will inspect the Seed Certifying Agency field inspection reports and seed analysis reports as well as all aspects of the grower’s facilities, equipment and operation, including seed increase fields.
1.0.3 The Contractor may apply for re-inspection on a field that failed to meet the minimum standards. The Contractor must apply and have the cause for rejection corrected before the deadline specified on the inspection report by the Seed Certifying Agency or CO/COR in California. There will be only one re-inspection per field. The Contractor shall pay any Seed Certifying Agency fees for re-inspections.
1.0.4 Shipment/delivery will not be authorized until the original seed analysis report is approved in writing from the CO/COR. A copy of the original seed analysis report may be requested from the seed lab by the CO/COR to ensure seed lot identity and quality standards are met for that species.
1.1 Acceptance
1.1.1 Acceptance of work will be determined by the Contractor's compliance with terms, specifications, performance standards and workmanship required by this contract and each subsequent delivery orders. Acceptance will be determined by meeting all crop inspection requirements, inspection and compliance of seed quality standards at time of delivery, except as provided below. Final acceptance requires seed lot compliance with Government seed quality standards and certification as applicable and seed delivery.
1.1.2 All seed lots must be tested for purity, viability, other crop seed, weed seed, all states noxious weeds, and crop and weed exam and meet seed quality standards, see Section D, Tables 2 and 3 or 5.5.5 through 5.5.8.. Both germination and TZ seed tests are acceptable viability tests and the seed test with the highest viability will be accepted for payment purposes. Seed analysis reports shall be sent to the CO/COR prior to acceptance. Upon review and approval of the seed exam report, the CO/COR will notify the contractor in writing to ship the seed to the location identified in the TO. No seed shall be shipped prior to written notification. Final acceptance of the seed occurs when the seed is delivered to the field unit, visually inspected and the seed is determined to comply with all the terms and conditions of the contract.
