SBU - CONTRACTING AND ACQUISITIONS

September 15, 2020

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

FAR Part 16.505(b)

1. Identification of the agency and the contracting activity:

The Office of Acquisition Management proposes a to modification to existing task order

SAQMMA15F0999 with exception to fair opportunity for travel management services on behalf of Office of Logistics Management- Travel Management and Policy Division;

A/LM/OPS/TMP. The total estimated cost is $5,612,000.00 for the full performance period through June 03, 2027.

2. Nature and/or description of the action being approved.

U.S. Agency of International Development (USAID) has requested to be added to the

Department’s existing Global ETS2 travel management task order SAQMMA15F0999, through Interagency Agreement (IAA) 7200AA20K00011, approved September 14, 2020. The subject task order was issued from the ETS2 global travel contract, GS33FAA009, held by CWTSatoTravel (CWT). This agreement will allow the Office of

Logistics Management, Travel Management and Policy Division to assist the travel needs of USAID employees posted to over 58 embassies and consulates located overseas by providing the same services currently performed under the Department’s travel services task order. Travel services will be purchased for official purposes through a centrally billed account (CBA) as stated on the approved IAA between the Department of State and USAID, 7200AA20K00011. The pricing will be a Firm-Fixed-Price to procure travel services for employees located domestically at the USAID Headquarters located in

Washington, DC. Firm-Fixed-Price rates are in accordance with existing pricing established under task order SAQMMA15F0999.

3. A description of the supplies or services required to meet the Department’s needs.

The IAA numbered 7200AA20K00011 between USAID and the Department is similar to the agreement the Department successfully entered with the U.S. Agency for Global Media

(USAGM- formerly BBG) several years ago. The scope of USAID travel operations, regulations (FAM, FAR, and FTR) are similar if not the same, in scope and cost.

Incorporating USAID services to the Department’s task order, would provide streamlined travel reservations for USAID domestic employees requesting a routine TDY trip, PCS travel, or travel assistance at a moment’s notice for emergency travel (AD/OD, EVT travel). Both agencies have similar travel requests for official travel, both agencies use the

Federal Travel Regulations (FTR), Foreign Affairs Manual (FAM) and Standard

Regulations (DSSR) for regulations and allowances requirements. Both agencies have employees assigned at the same posts and by using CWT, as the travel management center

(TMC), travel itinerary and bookings will be created in an efficient and cost-effective manner. CWT is the TMC at 58 posts worldwide and is utilized by tenant agencies at post such as USAID. This streamlined approach will reduce redundancies, and provide for a more efficient solution to providing the same travel management center services by two federal agencies. USAID has entered a similar agreement with the Department regarding

Transportation of Personal Effects for PCS travel, and the Department currently provides transportation management services to USAID through the use of one of the Department’s existing logistics support contracts.

CWT will provide on-site travel services to USAID at their 1300 Pennsylvania Avenue

Headquarters location in Washington DC, at a total estimated cost of $5,612, 000.00 for the remaining task order performance period through fiscal year 2027. These services require that travel services will be performed for the life of the task order.

4. Authority permitting a Fair Opportunity Exception and the supporting rationale.

This acquisition is conducted pursuant to 41 U.S.C. 4103 and 4106 as implemented by FAR

16.505(b)(2) and substantiated by the following:

☒ FAR 16.505(b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

5. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on established pricing under contract number SAQMMA15F0999.

6. Any other facts supporting the justification.

CWTSatoTravel is the one of few TMC-service providers that has a true global footprint that allows USAID travelers to make domestic and international reservations at a moment’s notice. Managing the USAID travel needs through one uniform TMC will streamline and reduce redundancies for federal travelers transitioning from overseas to domestic locations.

Additionally, this action consolidates financial obligations, monitoring, and voucher concerns.

7. Actions the agency May Take to Remove or Overcome Any Barriers to Increase

Fair Opportunity before any subsequent acquisitions for the supplies or services is made.

This is a highly specific and highly specialized travel contract in which many travel agencies will not have the knowledge of the FAM, FTR and knowledge of international pricing required to successfully perform these global travel services. CWTSatoTravel has been awarded the travel contract to USAID in previous years, and already have the institutional knowledge to implement a smooth transition from the current TMC to CWT.
