About this file

This is a Justification and Approval (J&A) document from the FBI's Finance and Facilities Division for other than full and open competition, dated January 31, 2025. The document justifies a sole-source procurement from DillonWorks Inc. for 20 custom faux cable pedestal enclosures that will be used by the FBI's Video Surveillance Unit (VSU) for surreptitious video collection.

The required enclosures must match the dimensions of Vertiv Model UPCBD3 (37.25" H x 6.75" W x 6.75" D), be weathered in appearance, constructed of RF transparent material, include interior mounting points for custom brackets, have a ground spike mounting system, and be weather-tight. DillonWorks Inc. is identified as the only known vendor capable of fabricating these concealment hosts with the required level of detail and RF transparency. The procurement was not advertised due to national security concerns and law enforcement sensitive (LES) requirements. Market research included attending NATIA trade shows, collaborating with other federal agencies, and reviewing past contracts, but no other vendors were found that could match DillonWorks' capabilities in replicating everyday objects for surveillance equipment integration.

This will provide the field Technical Investigative Program options in capability for collecting surreptitious video.

4. The statutory authority permitting other than full and open competition.

For purposes of this acquisition, the statutory authority permitting other than full and open competition is delineated at 41 U.S.C. 3304 (a) (1) and implemented at FAR Part 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

While VSU regularly attends tradeshows, efforts have been made to identify companies with identical quality and reproduction finesse as well as DillonWorks Inc. DillonWorks Inc. is only known vendor capable of fabricating custom concealment host for unique requirements.

DillonWorks Inc. has other clientele where they create props for the show business industry, and it is that level of detail that is required for situations where these concealments are deployed to capture video for investigative purposes. The actual pedestal that telephone and cable companies utilize that this faux pedestal is being replicated, is produced with a steel shell and therefore nullifies the ability for RF transparency. The material utilized in these custom fabricated pedestals is RF transparent allowing for the egress of our communications equipment.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Before awarding a contract, the Contracting Officer will perform a price analysis in accordance with FAR 15.804-2(a)-(e).

8. A description of the market research conducted and the results.

FULL AND OPEN COMPETITION

The custom faux cable pedestal enclosure manufactured by DillonWorks Inc. is one of many solutions the VSU Concealment Program utilizes to fulfill special mission requests from the field Technical Investigative Program. These were purchased previously via an IDIQ contract that has since expired.

Surveying industry for equipment that meets our needs is a continuous process for VSU. This process is ongoing and conducted through public forums and data gathering, as well as, collaboration with other Governmental agencies with similar requirements. Although they provide a good overview for global information on large, small and other businesses, public sources often do not reveal the granularity needed to completely evaluate a company’s ability to meet some of our specialized requirements. Many companies that market law enforcement related surveillance products do not publicly advertise their products. Additional information on companies stating that they provide video surveillance equipment is obtained from other sources. VSU routinely attends trade shows such as the National Technical Investigators’ Association (NATIA) targeted at law enforcement and government surveillance markets. This is an example of where efforts have been made to identify companies with identical quality and reproduction finesse as well as DillonWorks Inc. To this date, no other company has been found that can reproduce the exquisite details that DillonWorks Inc. can provide in replicating everyday objects for our equipment integration.

Market research was conducted using the following techniques:

Collaboration and technology exchanges with other federal government agencies to determine potential sources and identify current contract vehicles available to the

FBI.

Participation in vendor trade shows and conferences where this type of technology is advertised (NATIA)

Maintaining contact with industry to keep informed regarding new developments and emerging technology

Review of acquisition history and contractor performance for the current contract Internet research

9. Any other facts supporting the use of other than full and open competition.

Video surveillance technologies, techniques, equipment, and methods are, at a minimum, LES. Subjecting the requirements to Full and Open Competition would greatly benefit CI, CT, JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN

FULL AND OPEN COMPETITION

Requisition Number: SHOP-PR-25-000785 Version 2.5 Page 4 and criminal targets by readily providing reference or source information that could help identify countermeasure technology.

As described, due to national security concerns, and mandatory requirements to protect intelligence collection techniques and methods, the requirements cannot be publicly disclosed;

therefore, no sources sought notice or request for information was, nor can be, published.

10. A listing of any sources that expressed a written interest in the acquisition.

Since the procurement was not advertised, no other companies have expressed an interest either orally or in writing.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

VSU intends to continue to work closely with the market to ensure there are multiple vendors capable of meeting the same core requirements while allowing VSU to access niche capabilities that can be applied across the FBI’s diverse mission sets. Vendor engagement will include participating in NATIA conferences and evaluating vendor technology as the need arises. An example of this, is the Special Services Groups Street Light Cap. It meets the core requirements but is packaged into the form factor of a street light sensor. This product was purchased by VSU in CY2020 and continues to give the FBI another source for solutions to meet these requirements.
