About this file
This is a Justification and Approval (J&A) document for use of other than full and open competition in federal contracting.
The Department of the Navy, Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT) seeks to award a 12-month extension to T&H Service LLC for contract N4008518D9738 to provide Base Operation and Support (BOS) services at Marine Corps Air Station Laurel Bay, Beaufort, South Carolina; Laurel Bay Schools, Beaufort, South Carolina; and MCAS Housing Complex, Laurel Bay, South Carolina. The contractor shall provide all labor, management, supervision, tools, materials, and equipment required for BOS services. The bridge contract is effective June 1, 2026, through May 31, 2027, and will be funded with FY26 Operations and Maintenance (O&M) funding. The specific dollar amounts for recurring and non-recurring services are redacted in the document.
The justification for limiting competition is based on 10 U.S.C. 3204(a)(2) and RFO 6.103-2 (Unusual and Compelling Urgency). Delays in the pre-solicitation phase occurred due to changes in requirements identified after initial specification writing, and a required 90-day phase-in period is necessary for successful transition to full performance. Without the bridge extension, insufficient time exists to complete the source selection process and award a competed follow-on contract before the current contract expires May 31, 2026. The services are essential due to critical HVAC maintenance and repair requirements, and lack of proper maintenance could endanger life, health, and safety. NAVFAC is already procuring the follow-on contract, which will be awarded based on full and open competition with set-asides for 8(a) small business concerns per RFO 6.102-2(b).

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Department of the Navy, Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT), Norfolk Virginia.
2. Description of the Action Being Approved.
Award of a 12-month extension for contract N4008518D9738 to T&H Service LLC for Base Operation and Support (BOS) Contract at Marine Corps Air Station (MCAS), Laurel Bay (LB), Beaufort, SC; Laurel Bay Schools, Beaufort, SC; MCAS Housing Complex, Laurel Bay, SC.
3. Description of Supplies/Services.
The contractor shall provide all labor, management, supervision, tools, material, and equipment required to provide BOSC services at Marine Corps Air Station (MCAS), Laurel Bay (LB), Beaufort, SC; Laurel Bay Schools, Beaufort, SC; MCAS Housing Complex, Laurel Bay, SC.
The bridge action will be effective from 1 June 2026 through 31 May 2027 with an estimated value of ( recurring services, non-recurring services).
The bridge will be funded using FY26 Operations and Maintenance (O&M) funding.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(2); RFO 6.103-2, Unusual and compelling urgency. Contracting without providing for full and open competition under this acquisition may be accomplished pursuant to the authority of 10 U.S.C. 3204(a)(2) of the Revolutionary Federal Acquisition Regulation (FAR) Overhaul (RFO) 6.103-2, Unusual and Compelling Urgency. The agency’s need for these services is of such an unusual and compelling urgency that the Government’s mission would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals and waive synopsis requirements pursuant to RFO 5.101(b)(2).
5. Rationale Justifying Use of Cited Statutory Authority.
The use of the authority cited in Section 4 is deemed appropriate due to the urgent need for continued Base Operation and Support (BOS) Contract at Marine Corps Air Station (MCAS), Laurel Bay (LB), Beaufort, SC; Laurel Bay Schools, Beaufort, SC; MCAS Housing Complex, Laurel Bay, SC. The request for a bridge is required because of delays in the pre-solicitation phase. The specification package for the follow-on procurement was delayed due to changes in the requirements that were not identified during initial specification writing. This resulted in submission to contracting being delayed. In addition, a 90-day phase-in period is required for all

BOS contracts to support successful phase-in and transition to full performance. Without the requested bridge to continue the services, there is not sufficient time to complete the source selection process and make an award with the required 90-day phase-in/transition period before the current expires on 31 May 2026.
Base operation facility investment services include heating, ventilation, and air conditioning (HVAC) maintenance and repair services essential, as the lack of required maintenance and monitoring of systems in support of heating and cooling services could potentially result in life, health, and safety endangerment to military and civilian personnel.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Due to the urgent need for continued services, it is not practical or in the best interest of the Government to solicit additional sources for the required services.
The subject action will only bridge the gap until that competed contract can be awarded.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
This is a one-time exception to full and open competition, which is dictated by the exigent circumstances. As discussed in Section 5, NAVFAC is already in the process of procuring the follow-on contract, which will be awarded based on full and open competition after exclusion of sources in accordance with RFO 6.102-2(b), set-asides for 8(a) small business concerns.
