About this file

This is a Sole Source Justification document for a bilateral Task Order (TO) modification issued by the Department of Health and Human Services, U.S. Food and Drug Administration (FDA), Office of Acquisitions and Grants Services. The modification seeks to restore funding for Freedom of Information Act (FOIA) support services through Contact Government Services, LLC (CGS), located at 1100 13th Street NW, Suite 925, Washington, DC 20005. The TO (#75F40123A00033/75F40123F19001) was previously awarded on a competitive basis under a Blanket Purchase Agreement (BPA) with an initial one-year base period and two option years. Following the exercise of option year two, funding was reduced by $1,173,068.10 due to Executive Order 14222 cost efficiency initiatives, significantly constraining the FDA eDiscovery Office's FOIA support capabilities.

The modification restores the previously reduced level of effort (LOE) to increase FOIA support across multiple task areas, including Early Case Assessment, Data Collection and Processing, Data Search and Culling, Data Analytics, Document Review, Document Production, and Case Management, with an estimated workload of 1,000 FOIA Principal Case Assessments, 500 collections, and 50 reviews remaining through the Task Order's March 30, 2026 end date. The justification for sole source award is based on CGS's existing security accesses, institutional knowledge of FDA workflows and processes, and the efficiency gained by avoiding the onboarding delays associated with transitioning to a new vendor. The contract type is Time and Materials. The FDA anticipates re-soliciting this BPA in fiscal year 2026.
