About this file
This document is a Justification and Approval for Other Than Full and Open Competition (Overseas Contracting Activities) for the purchase of spare parts for an automatic voltage regulator (AVR) at the U.S. Embassy Baku in Azerbaijan. The estimated cost is $17,158.24.
The justification states that these spare parts are only available from the manufacturer, Watford Control Instruments Ltd, and are critical components required to provide stable, reliable power to downstream electrical equipment, including sensitive computer systems. A market survey was not conducted as the parts are only available from the single source. The justification cites the statutory authority under FAR 6.302-1 for a sole source acquisition, as no other supplier can provide the required parts. The Contracting Officer has determined the anticipated cost to the government will be fair and reasonable. The agency plans to replace the generator and AVR in 2026, at which point they may be able to overcome the barriers to competition.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)
1 recommend that Embassy Baku uses other than full and open competition for the acquisition of spare parts for automatic voltage regulator. The estimated cost is $17,158.24.
Nature and/or description of the action being approved. Purchase ofthe critical A VR parts as listed in the quotation for PRI2658322. Equipment spare part descriptions are attached.
2.
A description of the supplies or services required to meet the agency's needs. These spare parts make up critical components ofthe Chancery’s automatic voltage regulator (A VR).
3.
An identification of the statutory authority permitting other than full and open competition. 6.302-1 Only one re.^ponsihle source and no other supplies or services will satisfy agency requirements.
4.
A demonstration that the proposed contractors unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited). These spare parts are only available from the manufacturer Watford Control Instruments ltd company. These parts are required in order to provide stable reliable power to the downstream electrical equipment including sensitive computer systems.
5.
A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a
SAM.gov notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70). Offers cannot be solicited from as many potential sources as is practicable because only the manufacturer has the required spare parts. SAM.gov notice was not publicized because the procurement total does not exceed USD 203,000.00.
6.
A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
7.
A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. Market survey was not conducted because the ports are only available from the manufacturer.
8.
Any other facts supporting the use of other than full and open competition. None.9.
10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.
None
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The agency will be able to take actions to remove or overcome any barriers to competition if the generator is replaced with a new one with spare parts widely available. The generator and A VR are scheduled for replacement in 2026.
