Justification for Other Than Full and Open Competition – Summary
This is a Justification and Approval (J&A) document for a sole-source bridge contract award to McColm & Company LLC for specialized instructional support services to the National Foreign Affairs Training Center (NFATC), Diplomatic Tradecraft & Emerging Technology Directorate, Area Studies Division.
Requirement and Services: The Department of State Acquisition Management seeks to award a nine-month firm-fixed-price (FFP) interim bridge contract to McColm & Company LLC, located at 3100 Clarendon Boulevard, Arlington, VA 22201. The contractor will design, manage, and deliver comprehensive Area Studies courses spanning thematic, regional, sub-regional, and country-specific topics. Core services include course instruction with complete lifecycle management, course administration providing comprehensive administrative support, and guest speaker management including administrative and financial processing of honoraria and fees. The bridge contract prevents a critical lapse in mission-essential operations and ensures continuity for the NFATC's specialized instructional support for deploying foreign affairs personnel.
Justification and Authority: The acquisition is conducted under 41 USC 3304 using FAR 6.103-2 (Unusual and Compelling Urgency). The unusual and compelling urgency stems from organizational realignment requiring requirement refinement, industry feedback incorporation, and technical validation of new training content. Market research confirmed that McColm & Company is the only viable source capable of providing uninterrupted continuity with zero ramp-up risk due to incumbent institutional knowledge, specialized functional management capabilities, mid-cycle academic risks tied to active language-integrated course cohorts, and transition delays associated with security clearances and operational familiarization. The Government is executing a parallel bridge action with the second suite holder to preserve the dual-vendor framework, with future long-term competition anticipated under the GSA Multiple Award Schedule (MAS) vehicle. No pre-award notice will be published on SAM.gov citing FAR 5.101(b) exception due to serious injury to Department operations if standard publicizing timeframes were followed. The Contracting Officer has determined the anticipated price is fair and reasonable based on historical price comparison against the preceding Blanket Purchase Agreement, Independent Government Cost Estimate variance analysis, and market awareness data.
