About this file
This document is a Justification and Approval (J&A) for other than full and open competition for electromagnetic interference (EMI) and windblast testing on Forehead-Mounted Pulse Oximeters. The Naval Medical Research Command (NMRC) is requesting to sole source this testing to Dayton T. Brown, Inc. in order to assess the survivability of the TheraTactics Enhanced Pulse Oximeter devices in extreme environments. The EMI testing will evaluate radiated emissions and electric field impact, while the windblast testing will simulate flight ejection conditions up to 600 KEAS. The testing is funded through NAMRU-D project funds totaling $46,700. The statutory exceptions cited are 10 U.S.C. 2304(c)(1) for only one responsible source, and 10 U.S.C. 2304(c)(3) for engineering, developmental, or research capability. This J&A supports the related federal contract opportunity for Windblast testing.

JUSTIFICATION AND APPROVAL
OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity.
This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet Navy Expeditionary Medical Research requirements.
2. Nature and/or description of the action.
The proposed action is for Electromagnetic Interference (EMI) and Windblast testing performed on Forehead-Mounted Pulse Oximeters to determine survivability in extreme environments. The testing will consist of device setup, Radiated Emissions and Electric Field testing, four windlbast tests at varying KEAS with camera monitoring for each device, and a test report for each of the two types of testing. This proposed source is Dayton T. Brown, 1195 Church Street, Bohemia, NY 11716.
3. Description of Supplies or Services:
NAMRU-Dayton requests (two) TheraTactics Enhanced Pulse Oximeter (TT-EPO) devices and peripheral equipment be sent to Dayton T. Brown for EMI testing to assess the efficacy of the devices during electromagnetic interference. The DTB test facility must provide the following capabilities:
1. Initial device and testing environment setup
2. RE102, radiated emissions in an electric field
3. RS103, radiated susceptibility in an electric field
4. Testing report of findings
Additionally, we are requesting (two) TheraTactics EPO devices and peripheral equipment be sent to DTB for Windblast testing to assess the efficacy of the device in a simulated flight ejection environment. The DTB test facility must provide the following capabilities:
1. Initial device and testing environment setup
2. Two Windblast shots at 450 KEAS
3. Two Windblast shots at 600 KEAS
4. High speed video cameras usage
5. Testing report of findings
Success or failure of windblast testing is determined by MIL-STD-810H. Success or failure of EMI testing is determined by MIL-STD-461, RE102 and RE103.
Funds from NAMRU-D project entitled “Thera Tactics Enhanced Pulse Oximeter, FY23 Protective Clothing and Devices program funds for Systems Engineering 1 N0001923WX03184”(NWA 100002142216 0043) in the amount of $46,700 will be used to perform the device testing requirements.
4. Identification of the statutory exceptions permitting other than full and open competition.
The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and FAR 6.302-1 sole source (including brand name) acquisitions or FAR 13.106-1(b)(1) soliciting from a single source.
10 U.S.C. 2304(c)(1), Only one responsible source.
10 U.S.C. 2304(c)(3), Industrial mobilization; engineering, developmental, or research capability; or expert services.
Be sure to include the FAR cite as well. See attached FAR explanation sheet for J&A references FAR Part 13 FAR 13.106-1(b)(1) <$150K
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
Dayton T. Brown (DTB) is one of the largest and most versatile independent testing laboratories in the nation. As a proven leader in Environmental testing, DTB offers customized solutions.
DTB’s enhanced Windblast Facility simulates uniform airstream velocities consistent with velocities experienced in actual ejections from aircraft up to 700 Knots Equivalent Airspeed (KEAS). DTB is the only CONUS windblast facility capable of meeting this air blast profile.
The facilities and services are in alignment with AS9100D requirements to include:
comprehensive test reporting, product development support, product conformance inspection, and product improvement. DTB designs, develops, and implements specialized test equipment for customers in government, military, and commercial markets. DTB is a proven leader in Electromagnetic Interference (EMI) testing. DTB verifies the ability of equipment to withstand electromagnetic interference by bombarding it with electromagnetic energy.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Market research was performed, the results of which are in paragraph 8. This requirement will be posted to the government point of entry in accordance with FAR 5.202.
• A synopsis of the proposed procurement will be published in NECO and/ or FEDBIZOPS. The government will evaluate any responses received.
• Whether other market research was conducted.
7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the Dayton T Brown’s commercial price list and will be determined fair and reasonable.
8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.
Market research was conducted in June 2023 time frame. This research consisted of reviews of previous procurements of these types of testing and a market survey through search engines of open market contractors and government contractors. Search engines utilized include Google, USA Spending, and GSA Advantage using the following search words: windblast and electromagnetic interference. Search results showed that Dayton T Brown was the only windblast testing facility that was also able to perform EMI testing. Other companies with wind based testing only perform wind tunnel testing for the purpose of testing vehicles and aerospace parts, and not windblast or EMI. The 711th Human Performance Wing was also contacted based on their previous correspondence and contract with Dayton T Brown. Dayton T Brown is the only source that can meet the Government’s requirements.
9. Other facts supporting the use of other than full and open competition.
The requirements for EMI and windblast testing were requested as a sole source by the 711th Human Performance Wing at Wright Patterson Air Force Base in 2022. The contract was awarded to Dayton T Brown through CREDA agreement No.00-127-HE-01, totalling $44,650.
The contract was awarded due to the ability to perform both types of testing in a single facility.
10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.
To date, no other sources have written to express an interest.
11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Future requirements will be synopsized in accordance with FAR 5.203.
For the reasons set forth in Paragraph 5, NRMC has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NMRC will assess whether competition for future requirements are feasible.
The Government (or Program Office) expects to obtain a technical data package that will support competition for future acquisitions of the same or similar items.
12. Point of Contact:
The point of contact at the Naval Medical Research Command, Silver Spring, MD, regarding the contents of the sole source justification are the Contracting Officers in the Material Management Department (MMD) and can be reached by emailing usn.detrick.nmrc.mbx.mmd-contracts@health.mil.
