1. Contracting Activity: Department of Veterans Affairs, VISN 22, VA Long Beach Medical Center.

2. Nature and/or Description of the Action Being Approved: This action will be awarded as a new base plus four option year, Firm Fixed Price service contract.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: Tibor Rubin Veterans
Affairs Healthcare System located in Long Beach, California requires annual and bi-annual preventive maintenance services for four (4) condenser water pumps, eight (8) chilled water pumps, and four (4) cooling tower motors and gearboxes. The period of performance is for a base year with an estimated start date of September 15, 2025, and up to four (4) option years at the Government discretion. The total estimated contract value is $384,001.00.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38
U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): VAAR 819.7008 allows sole source awards to SDVOSB/VOSB concerns based on 38 U.S. Code § 8127(c). The SDVOSB concern meets the eligibility requirements in VAAR 819.7003(DEVIATION) because (1) they have been determined to be a responsible source with respect to performance, (2) the total estimated value of this requirement is below $5,000,000.00, and (3) they are an SBA verified SDVOSB concern.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies: A notice will be publicized as required by FAR 5.2 prior to award.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: Price reasonableness was determined by reviewing historical price on existing contracts and previously awarded contracts for similar services.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: The vendor meets the eligibility criteria outlined in VAAR 819.7003(DEVIATION), they have been determined responsible in respect to performance, they are verified in SBA’s VetCert and the action is below the $5M threshold.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. In accordance with 41 USC §3304(a)(5) and 38 U.S. Code § 8127(c), COs may use the non-competitive procedures authorized in VAAR 819.7008 (DEVIATION).

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: IAW Construction, INC.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A competitive solicitation will be issued in the future if there is continued need for these services.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
