About this file

This is a Justification and Approval (J&A) document for a sole source contract award to a Service-Disabled Veteran-Owned Small Business (SDVOSB).

The Department of Veterans Affairs (VA), Veterans Integrated Service Network (VISN) 22, on behalf of VA Long Beach Healthcare System (VALBHCS), is extending an existing contract for Shuttle and Valet services with Marquis Solutions, LLC (UEI: RBHRGFTRZB78), a certified SDVOSB concern. The extension is for four months with a total estimated value of $717,272.00 and a period of performance extended to January 31, 2027. The services include continuous shuttle operations throughout the VALBHCS campus and associated parking areas using buses and carts, as well as full valet parking services, designed to help Veterans safely access the medical center and minimize barriers to care. This sole source extension under existing Contract Number 36C26226P0993 is authorized under VAAR 819.7008, which permits non-competitive awards to certified SDVOSBs up to $5,000,000, and is based on statutory authority under 41 USC §3304(a)(5) and 38 U.S. Code § 8127(c). The extension is necessary to maintain continuity of mission-critical services for four months pending the outcome of a Government Accountability Office (GAO) protest (B-424859) filed on September 23, 2026, which challenged an award decision announced on September 22, 2026, for a new base plus four option year contract under Solicitation #36C26226Q0512. The extension utilizes four of the six months available under FAR Clause 52.217-8 (Option to Extend Services) and is structured as a Firm-Fixed Price contract. The Contracting Officer determined the anticipated cost to be fair and reasonable based on review of proposed rates, historical pricing, Independent Government Cost Estimates, and prevailing market rates. Prior market research confirmed adequate SDVOSB competition exists for these services.

2. Nature and/or Description of the Action Being Approved: This procurement is for Shuttle and Valet services and is being conducted in accordance with Revolutionary Federal Acquisition Regulation Overhaul (RFO) 6.103, Other than full and open competition, and FAR 52.217-8, Option to Extend Services. These services are currently being provided under Contract Number 36C26226P0993, which includes FAR Clause 52.217-8. A four-month extension under this contract is essential to maintain ongoing transportation support pending the outcome of a Government Accountability Office (GAO) protest. This extension will utilize four out of the six months available under FAR 52.217-8. This is a Firm-Fixed Price contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Shuttle and Valet services help Veterans safely access the medical center and minimize barriers to care, which is especially important for Veterans with mobility challenges, chronic conditions, or disabilities.

These services include continuous shuttle operations throughout the VALBHCS campus and associated parking areas using buses and carts, as well as full valet parking services. These services were competitively solicited under Solicitation #36C26226Q0512. An award announcement was made on September 22, 2026, and a new contract was expected to begin on October 1, 2026;

however, a protest was submitted to the GAO [GAO protest B-424859] on September 23, 2026, challenging the award decision and postponing the start of the new contract. This extension is needed to ensure continuity of mission-critical services for four months, pending the outcome of the protest. The total estimated value of this extension is $717,272.00, and the period of performance is extended by four months to 01/31/2027.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by RFO 5 and, if not, which exemption under RFO 5 applies: Due to the urgent and compelling nature of this requirement, soliciting competition is not practicable. In accordance with RFO 5.101(b)(2), a pre-solicitation notice was not posted. These services were previously solicited under Solicitation #36C26226Q0512, however, due to a protest of the award decision, a four-month extension of Contract Number 36C26226P0993 is needed to ensure continuity of these mission-critical services pending the outcome of the protest. The justification will be posted within 30 days of contract award.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: In accordance with RFO 12.204 (a), the Contracting Officer (CO) determined that the anticipated cost to the Government will be fair and reasonable.
