About this file

This document is the Hawaii Bidder/Offeror Preference Certification Form (JUD-081) issued by the State of Hawaii Judiciary for use in response to solicitations related to statewide sample collection, drug screening, and confirmatory testing services. Bidders seeking to claim Hawaii preference must certify compliance with four primary requirements: maintenance of a valid commercial place of business in Hawaii that has been continuously staffed for at least two consecutive years prior to bid opening; submission of the bid under the authorized business name; commitment to perform not less than 51 percent of total direct labor hours within the State of Hawaii; and, if applicable, composition entirely of qualified joint venture parties meeting all requirements. The contract involves providing statewide sample collection, initial drug screening, and confirmation testing services to Hawaii Judiciary courts across four circuits—First Circuit (Oahu), Second Circuit (Maui, Moloka'i, and Lana'i), Third Circuit (Hawai'i), and Fifth Circuit (Kaua'i)—with sample collection conducted at contractor or approved sub-contractor facilities and confirmation testing performed using gas chromatography/mass spectrometry by a Hawaii-licensed and accredited company.

The certification form requires bidders to acknowledge that failure to maintain stated qualifications throughout contract performance will result in a price adjustment equal to the value of the preference applied and may constitute cause for debarment under Hawaii Revised Statutes Section 103D-702. Authorized officers must certify under penalty of perjury that all statements are true and agree to report any changes in eligibility to the contract administrator or purchasing agency contact identified in the solicitation. Pricing is structured as a unit bid cost per test, with monthly billings adjusted according to actual samples collected; the Judiciary reserves the right to increase or decrease collection volumes without modifying the unit cost. This preference certification mechanism establishes eligibility criteria for Hawaii-based businesses to receive preferential consideration in the competitive bidding process.
