About this file

This document is a justification for a sole source award to replace two failed pumps at the Katherine Landing lift station. The pumps are integral to the sewer system serving the developed area and marina. With one pump already failed, replacing both pumps on an expedited basis is critical to avoid potential environmental contamination and closure of park facilities. The pumps must be direct replacements for customized Grundfos pumps currently installed, requiring the services of Barrett Engineered Pumps as the original installer with expertise in the existing configuration. Market research found no other vendors able to both supply the specific pumps needed and perform the specialized installation. The notice of sole source posted on SAM.gov received no alternative offers. Therefore, the contracting officer determined award to Barrett Engineered Pumps is in the best interest of the government on the basis of urgent need and the company being the only reasonably available source.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR

Part 2) UP TO SAT

(See FAR 13.106-1)

Date: August 19, 2023

PR Number: 40636869

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

A lift station pump at Katherine Landing has failed prematurely due to a faulty seal. This pump is integral to the sewer system at Katherine Landing as it pumps raw sewage from the marina to the treatment ponds.

Without them in service the developed area would need to be closed down and no services offered.

This is a 2 pump engineered system and with 1 pump down the station’s capability is reduced by half.

Furthermore the system has no backup now. If the remaining pump fails before we receive the new pumps we will be out of options.

This acquisition is for 2 new direct replacement Grundfos pumps with ceramic coating and installation of pumps.

The estimated cost to supply and replace the 2 pumps is $46,200.

2. Sole Source Justification rationale (Check one and explain below):

___X___ Only one responsible source.

______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

___X___ Other: Brand Name Justification

Explain: A direct replacement of Grundfos pumps is needed to ensure timely replacement of these pumps without needing to re-pipe the system to facilitate a different pump. Lead times are extended due to shortages and I have been quoted 18 weeks. This is the longest we can possibly make it and may not make it to then. The wet well in which these pumps reside is piped and engineered for this style Grundfos pumps as well as the safety system, electrical controls, switches, limits and rail system. It would cost over

$500,000.00 to re-engineer or change these components to facilitate a different style pump.

Due to the urgency of this project and the risk of raw sewage contaminating the lake if the backup pump fails, there is not additional time to expend to solicit competitively, organize pre-quotation site visits to allow vendors to view the lift stations, or provide answers to technical scope questions as the park staff do not have the technical knowledge of the existing pump configuration and it would take added time to consult with the original installer of the pumps. While there are other vendors that can supply the pumps in its base form, Barrett Engineered Pumps is the company that originally customized and installed these pumps in the Katherine Landing lift stations and has knowledge of the current pump configuration at the lift station. Therefore, it is in the government’s best interest to expedite issuance of a direct award to

Barrett Engineered Pumps for this specific requirement.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

Barrett Engineered Pumps (SAM UEI# E756Q41DGGL3) is the only authorized vendor that can supply and install the pumps for this application, as demonstrated in previous contracts for similar pump replacement performed at Lake Mead NRA. They are fully aware of the park site conditions, pumps and operation of the systems, and they are the only company capable to restore the lift station back to normal efficiency with very low performance risk. The program office attempted to get pricing from 2 other vendors and one came back at $80-$100,000.00 for the same pumps and the other said not available. To further support this notion, the Contracting Officer posted a Notice of Intent to Sole Source (Notice #

140P8123Q0126) to SAM.gov on 8/25/2023 to identify contractors other than Barrett Engineered Pumps that can both supply and install the pumps. In the notice, vendors were asked to submit their experience/capability on or before the response date for this notice and clearly state their capability to supply and perform onsite replacement of the Grundfos pumps. There were no responses to the notice by the close date of 8/29/2023 at 9:00 am. Therefore, it is reasonable to believe Barrett Engineered Pumps is the only company that can reasonably perform the installation and supply the required brand of pumps.

In an effort to expedite the pump replacements to avoid the risk of compromising public health and safety, the Contracting Officer determines it is in the best interest of the government to single source award to

Barrett Engineered Pumps as authorized by FAR 13.106-1(b) on the basis that the pumps must be replaced urgently and there is determined to be only one reasonably available source that can both supply and replace these pumps.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
