About this file

This is a Determination to Solicit from a Single Source document for the Department of Interior (DOI), Bureau of Reclamation (BOR), Interior Region 10, California Great Basin. The document authorizes a non-competitive procurement from Yerba Buena Engineering & Construction, Inc. for an urgent HVAC system replacement at an Administration Building. The project involves completely removing the existing failed HVAC system and installing either a 10-ton Trane commercial external heat pump system or two 5-ton external units with air handlers, to be completed within 30 days of Notice to Proceed.

The urgency stems from extreme interior temperatures reaching 115 degrees, which have forced eight full-time employees to work remotely and significantly disrupted mission-critical operations. A sources sought notice was issued, but only one contractor responded. The Contracting Officer determined that immediate procurement is necessary to restore safe working conditions and ensure uninterrupted mission support, with the price to be evaluated using FAR 15.404-1 techniques. The government plans to conduct comprehensive market research for future requirements to promote competition whenever practical.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. The Department of Interior (DOI), Bureau of Reclamation (BOR), Interior Region 10, California Great Basin (CGB), Construction Acquisitions Office located in Sacramento, California.

2. Name and Address of Single Source. Yerba Buena Engineering & Construction, Inc., 1340 Egbert Ave., San Francesco, CA 94124

3. Description of Supplies/Services and Estimated Cost. The construction work involves the complete removal of the existing failed HVAC system and installation of a replacement system consisting of either one Trane brand unit or a comparable commercial-grade HVAC system. The replacement will be a 10-ton commercial external heat pump system, or alternatively, two 5-ton external units with two air handlers located inside the buildings HVAC room. The unit will be powered by a 440/460 supply.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-1(b)(1)(i), only one source will be solicited because of the urgency of this requirement. The work must be completed as soon as possible. The scope of the work states the contract completion number of days as 30 days within issuance of Notice to Proceed.

This office became aware of the requirement on August 12, 2025. It has been determined that the existing HVAC system failure directly impacts eight full-time employees occupying offices within the Administration Building. During peak summer months, interior temperatures have reached up to 115 degrees, creating unsafe and uninhabitable working conditions. As a result, staff have been compelled to work remotely, which significantly disrupts daily operations and undermines the Administrations ability to effectively execute mission-critical, in-person objectives.

Continued reliance on remote work due to inadequate facility conditions poses unacceptable risks to productivity, employee health and safety, and overall mission readiness. Any delay in replacing the HVAC system would result in further disruption to Government operations and create an unacceptable risk to mission execution. Therefore, immediate, non-competitive procurement of a full system replacement is required to restore safe working conditions and ensure uninterrupted mission support.
