About this file

This document is a Justification for Other Than Full and Open Competition (JOTFOC) under 10 U.S.C. 3205 and FAR Subpart 13.5 for the U.S. Coast Guard (USCG) to procure 66 brand name Metrex Air Conditioning (A/C) Water Regulating Valves. The USCG intends to install these valves on its 418-foot National Security Cutters. The estimated total value is $1,733,754. The valves are proprietary to Metrex and are the only ones compatible with the USCG's existing network, maintenance platforms, and configuration. The contract type is Requirements with Firm Fixed-Price Delivery Orders, and the anticipated award date is September 24, 2024. The USCG conducted market research and outreach to authorized distributors, but Metrex is the sole source for these valves. The requirement is set aside for full and open competition among Metrex's authorized distributors.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

10 U.S.C. § 3205

In compliance with Federal Acquisition Regulation (FAR) 13.501(a)(1)(ii) this justification uses the format as FAR Subpart 6.303-2 and is modified to state that the procedures in FAR subpart 13.5 are used.

1. Agency and Contracting Activity.

The Department of Homeland Security, United States Coast Guard (USCG), Surface Forces

Logistics Center (SFLC), Contracts and Procurement Division (CPD), Branch 2 Long Range

Enforcer Product Line (C&P2 LRE) prepared this justification for other than full and open competition.

2. Nature and/or Description of the Action being Approved.

(a) Nature of the action: USCG SFLC intends to procure sixty-six (66) brand name Metrex Air Conditioning (A/C) Water Regulating Valves.

These Metrex A/C Water Regulating Valves will be installed onboard the Coast Guard 418-foot National Security Cutters.

(b) Below is a list of authorized distributors, to include the OEM:

(c) Type of action: The anticipated contract type is Requirements with

Firm Fixed-Price Delivery Orders.

(d) The Estimated total value is $1,733,754.00.

(e) Type of funding: Surface Operations.

(f) Year of funding: Fiscal Year 2024.

(g) Solicitation number: 70Z08524QAB037B00.

(h) Background information about the requirement: The USCG SFLC LRE

PL intends to procure, on a brand name basis, sixty-six (66) A/C Water

Regulating Metrex Brand-name valves 3 inch, 3-way marine regulating valve, special CuNi body and NiCu components, marine service ANSI flange connections, 150 PSI MAX. Inlet pressure, 50-250 PSIG refrigerant range. Flare fitting bellows, trim 'B' CV 50. The manufacturer: Metrex Valve Corp is the only one that provides this upgrade and the required technical support. Purchased Air Conditioning

(A/C) Water Regulating Valves will be installed onboard the Coast

Guard 418-foot National Security Cutters. The current project is under contract number 70Z08524P40015B00, which was awarded on 19

January 2024.

3. Description of Supplies/Services. The requirement is for the delivery of sixty-six (66)

Metrex A/C Water Regulating Valves. The estimated date of delivery is 180 days after award.

4. Identification of Statutory Authority Permitting Other Than Full and Open

Competition. The statutory authority permitting other than full and open competition is

10 U.S.C. § 3205 implemented by FAR Subpart 13.5(a)(1)(ii), Simplified Procedures for

Certain Commercial Products and Commercial Services.

5. Identification of Exception to the Buy American Act. The Buy American Act applies to this requirement.

6. Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Require Use of the Authority Cited.

Metrex A/C Water Regulating Valves are proprietary and is the only brand name that can fulfill this requirement. Metrex A/C Water Regulating Valves are the only valves that have the ability to interconnect and function with the current USCG network architecture, maintenance platforms, and configuration. Purchasing another brand of valves increases the risk of failure in open waters and delays to United States Coast Guard operations. This would result in schedule impacts that would substantially reduce the ability of the WMSL platforms to support United States Coast Guard missions around the globe.

Additionally, procuring these valves from another vendor is not feasible as it would require purchasing and configuring new equipment, changing control boards, and implementation of a new system and would require duplicity of effort.

Therefore, Metrex A/C Water Regulating Valves are the only valves that can be used to fulfill this requirement.

7. Description of Efforts Made to Ensure that Offers are Solicited from as Many

Potential Sources as is Practicable. The Contracting Officer utilized several methods to ensure as many offers are solicited as practicable. An Acquisition Planning Forecast

(APFS) record F2023063801 was published to the APFS website, a Sources Sought notice was on SAM.gov, and lastly, the contract specialist reached out to authorized distributors.

8. Determination by the Contracting Officer that the Anticipated Cost to the

Government will be Fair and Reasonable. The contracting officer will determine that the anticipated price will be fair and reasonable prior to contract award in accordance with FAR

Subpart 13.106-3, utilizing a combination of price analysis techniques.

9. Description of Market Research. Market research has yielded that A/C Water Regulating

Valves are commercially available and the item is a brand name item available from several authorized distributors.

10. Any Other Facts Supporting the Use of Other Than Full and Open Competition.

Metrex A/C Water Regulating Valves are paramount in supporting, the Coast Guard 418-foot

National Security Cutters. These parts are the only parts supported by the current USCG infrastructure.

11. A Listing of the Sources, if Any, that Expressed, in Writing, an Interest in the

Acquisition.

Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or

Services Required. Metrex A/C Water Regulating Valves are the only parts capable of fulfilling this requirement. The OEM has several authorized distributers, and this requirement will be competed among the authorized distributors. At this time, the USCG does not intend to replace the existing system therefore competition will be limited to authorized distributers.

13. Contracting Officer's Certification.
