JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER $10,000 ($2,000/$2,500 for Construction/Services) AND

UP TO $250,000

(See FAR 13.106-1)

Date: August 20, 2021 PR Number: 0040551160

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

The National Park Service at Point Reyes National Seashore has an urgent requirement for the removal of a 38-foot recreational vessel by north of Driftwood Beach (38 12.19 N, 122 58.17 W) where it recently ran aground. The expedited removal of the vessel is critical to protect natural resources in designated wilderness. As the vessel is inaccessible by land and requires collection of the vessel by a professional salvage company with salvage crew and helicopter. The total estimate cost for this service including disposal is .

2. Sole Source Justification rationale (Check one and explain below):

Only one responsible source.

X Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

Other

Explain: The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(2).

FAR Part 5.202 (a) (2) - The contracting officer need not submit the notice required by 5.201 when - The proposed contract action is made under the conditions described in 6.302-2 (or, for purchases conducted using simplified acquisition procedures, if unusual and compelling urgency precludes competition to the maximum extent practicable) and the Government would be seriously injured if the agency complies with the time periods specified in 5.203.

The National Park Service has secured limited competition; however, due to the urgency of this requirement as described below, the contracting officer will not be soliciting quotations through the government point of entry (Federal Business Opportunities) and has solicited written quotes from local capable sources who would likely be able to immediately respond.

The vessel, "JIM-ME" ran aground on the evening on August 2, 2021 but was not discovered until a fishing vessel noticed it on the morning of August 3, 2021. The United States Coast Guard (USCG) deployed for a rescue but was unable to access the boat and the occupant was retrieved via jet ski. The National Park Service was notified of the incident around noon on August 3, 2021 and immediately reached out to USCG Sector San Francisco due to the concerns of hazardous material leaking into the ocean. Other agencies notified were NOAA, California Fish and Wildlife, Marin County, and the Department of Public Works.

On the afternoon of August 3, 2021, the USCG contracted company Global Dive to remove the hazardous material from the vessel. Further, they requested that company Parker Diving Service respond to the site for an assessment. Both Global Dive and Parker Diving Service received photos and the location of the vessel and both companies provided the NPS with estimates and availability time frames for removal.

Both companies are familiar with the area and have the crew and technical abilities to safely remove the vessel without damaging park resources.

As of August 5, 2021, the vessel began to take on water and break up on the rocks. The need to salvage boat remnants is critical in the protection of this designated wilderness area of Point Reyes National Seashore. It is necessary to collect any remaining boat debris and contents, such as wood, fiberglass, metal, plastic, and electronics to prevent harm to the natural resources, which include rocky intertidal invertebrates and shorebirds. Cleaning the debris will also help prevent spread to other beaches where the threatened snowy plover resides.

This area of wilderness is inaccessible by land, as such crews will need to access the site and remove debris by helicopter, just as was done with the USCG hazardous fuel removal operation. It is critical the salvage operation commence as soon as possible so as not to leave debris which could harm natural resources.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

This is a commercial service and only a limited number of capable commercial vendors are available to perform this service and may be dedicated to other emergency operations such as active California wildfire response or responding to other incidents/accidents that require their services. A quick Market Research analysis revealed two local businesses that appeared capable of meeting our urgent requirement.

Parker Diving Service, located in Sausalito, CA, is a nearby salvage company with historic knowledge of the park’s resources and hazards and has been used on several occasions to remove vessels from Tomales Bay, North Beach, Limantour Beach, Chimney Rock, South Beach, and other locations in and around West Marin County by various city, county, state, and federal agencies.

Global Dive, with a Bay Area office in West Sacramento, CA, assisted the USCG in the removal of the hazardous material from this vessel and is familiar with the debris location. It has the crew and technical abilities to safely remove the vessel without damaging park resources and has a readily accessible helicopter.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
