About this file
This document is a Justification and Approval for Other than Full and Open Competition for Embassy Kuala Lumpur's procurement of rental vehicles and drivers. The contract, valued at $823,216 with a minimum guarantee of $11,904, is for supporting a VVIP visit to Malaysia in October 2025. Due to the late confirmation of the visit in September 2025 and the urgent need to arrange transportation within two weeks, the embassy is seeking an expedited procurement process under the Unusual and Compelling Urgency statutory authority.
The contract will provide vehicles and drivers to transport staff between hotels, meeting locations, and airports during the visit. The General Services Office (GSO) requested quotes from rental companies capable of supporting the visit, with the justification noting that the compressed timeline precludes full and open competition. The anticipated costs are considered fair and reasonable based on market analysis, with the requirements deemed unique enough that future visits will use standard competitive procurement methods.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)
1. I recommend that Embassy Kuala Lumpur use other than full and open competition for the acquisition of rental vehicles and drivers for a VVIP Visit in October 2025.
The estimated cost is USD $823,216
The minimum guarantee for these services is USD $11,904.
2. Nature and/or description of the action being approved.
This is a new contract for vehicle services not related to any other current or previous purchase.
3. A description of the supplies or services required to meet the agency's needs.
Vehicles and drivers are needed to support a VVIP visit to Malaysia. These meetings require vehicles and drivers to transport staff from hotels to meeting locations and the airport on arrival and departure.
4. An identification of the statutory authority permitting other than full and open competition.
[ X] 41 U.S.C. 253 (c) (2), FAR 6.302-2: Unusual and Compelling Urgency: (Based on the available time and urgency of the requirement as detailed below)
The VVIP visit will be held in late October 2025. The visit was only confirmed in September 2025.
The first travelers will arrive within two weeks of visit notification. The lack of time before U.S.
government travelers arrive does not allow enough time for full and open competition.
Delay in award of the contract will result in greatly increased prices and cost to the government.
Many of the arrangements for hotel and transportation are often not confirmed until just before the actual visit. In addition to supporting a large delegation within a short time frame, last minute and frequent changes of itineraries for supporting personnel often result in significant changes in how Posts work with the vendors. With the exception of a few trips, contracts are not permitted to be signed until the Department of State (Post) has written confirmation from all supporting agencies, which enables collection of funds from said agencies in the event of cancellation. This results in an unusual and compelling urgency in accordance with 41 U.S.C. 253 (c) (2), FAR 6.302-2.
5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies.
GSO requested quotes from rental companies that have the capacity to support this visit. Notice need not be submitted as the compelling urgency precludes competition to the maximum extent practicable.
6. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
