About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document authorizing a sole-source acquisition by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

The ATF's Technical Operations Branch requires replacement of a failed Uninterruptible Power Supply (UPS) system at its facility located at 42250 West Severn Way, Sterling, VA 20166. The procurement is justified under the authority of 41 U.S. Code § 3304 and RFO 6.103-2 (Unusual and Compelling Urgency) due to a recent power surge that disabled the existing UPS system, leaving sensitive, high-value equipment and materials vulnerable to damage. The facility houses permanent HVAC systems and critical infrastructure requiring stable power. The deliverables include installation and removal of an MSR60K 60kVA/54kW UPS system with three 20kVA power modules, Orion MSR EBC battery modules, SNMP Version 4 communications card, on-site startup services, and preventive maintenance support. The award is to Santa Fe Power Solutions, a small business, in the amount of $66,416.25 for a single order with four 1-year options for preventative maintenance. The period of performance is three months plus two 4-year option years. The contracting officer, Courtney Middleton, determined the proposed price to be fair and reasonable based on commercial market knowledge. No formal market research or public notice was conducted due to the urgent nature of the requirement. The document received approvals from the ATF Competition Advocate and was signed by the Contracting Officer on October 6, 2026.

5. Services: A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the referenced authority.

The Technical Operations Branch (TOB) recently experienced a power surge that resulted in a complete power outage. The existing Uninterruptible Power Supply (UPS) system—designed to filter “dirty power,” provide battery backup, and prevent outages which failed to activate due to a critical malfunction. As a result, the entire facility was left vulnerable to additional power surges no protection or backup power capability.

This facility houses sensitive, high-value equipment and materials essential to mission execution.

Continued exposure to unstable electrical conditions places this equipment at significant risk of damage or loss, which would directly degrade the unit’s ability to perform required mission activities.

The government has deemed this situation as Urgent and compelling due to UPS system failures and inability to install permanent HVAC units in the warehouse where it gets over 100 degrees. The loss of power at the facility results in failure of the UPS system. When utility power is restored, the system failure prevents power from returning from the utility without manually bypassing the system. This causes temperature to surge in the space until a maintenance technician can respond.

This requirement goes hand to hand with the HVAC electrical previous JOFOC to green to grounds (15A00026PAQA00247). The electrical workaround was completed on September 9, 2026, but it was only a temporary fix. The UPS system is experiencing power surges that affect both the HVAC and the building’s electrical systems. The previous vendor was responsible for integrating the HVAC system with the new UPS system. The advantage of moving forward with this approach is that the new system will operate using a plug-and-play configuration, eliminating the need to procure additional electrical services once the new UPS system is fully operational.

Currently, ATF installed temporary HVAC system, however the existing UPS system has failed.

When there is any disruption to utility services, it is unable to maintain climate control in this facility.

Due to the nature of the requirement, vendors were contacted to have the system up and running. UPS replaces and installs services have not been rendered as of September 18, 2026. The suggested vendor was selected since they will be providing an UPS system that is nonproprietary, which will prevent ATF from being locked into one provider for the life of the unit. This will provide flexibility in maintaining this system a potentially cost saving over its lifecycle.

This action provides power infrastructure needed to supply power to permanent HVAC systems and other infrastructure for continuity of operations at this facility, while operating under a high vulnerability status. Currently, the warehouse temperatures cause damage to critical and expensive equipment and supplies. Existing UPS system is not operational and does not meet requirements for this operation.

6. A description of efforts made to ensure offers/quotes were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by RFO 5.1 and, if not, which exception under RFO 5.201(b) applies.

No notice or solicitation was submitted. Several local qualified vendors provided quotes for the work.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the contracting officer that the anticipated cost to the government will be fair and reasonable.

Contracting Officer’s knowledge and experience with the commercial market for UPS equipment, battery replacement, installation, and maintenance services. This knowledge, including familiarity with pricing for comparable equipment and services acquired in the commercial market place, supports the determination that the proposed price is consistent with prices reasonably expected for this type and scope of requirement. Considering the urgent circumstances of the acquisition and the available market information, the Contracting Officer determines the proposed price to be fair and reasonable. An award to Santa Fe Power Solutions, a small business, in the amount $66,416.25 is in the best interest of the Government.

8. A description of the market research conducted and the results or the reason market research was not conducted.

This procurement is of an urgent nature; extensive market research was impractical. Identifying a qualified vendor that can perform the work in the time was the most urgent factor.

9. Any other facts supporting the use of other than full and open competition.

N/A

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

N/A

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition.

The agency will continue to assess procurement processes and requirements to identify and remove any barriers to future competition. Given the urgent and compelling circumstances surrounding this requirement, the agency will take all feasible steps to promote competition in future acquisitions.

Once the immediate need is resolved, the agency will conduct a thorough review of the requirement, engage in enhanced market research, and reassess technical specifications to ensure they do not unintentionally limit competition.
