About this file

This is a Justification for Other than Full and Open Competition document for a service contract with Thermo Fisher Scientific to provide preventative maintenance and repair services for six ABI 7500 Fast Real-time PCR systems used by the FDA's Arkansas Human and Animal Food Laboratory (ARHAFL). The contract is a 5-year agreement from 9/1/2025 to 8/31/2030, with a total estimated value of $232,357.32, broken down into one base year and four option years. The systems are critical for molecular screening of high-risk pathogens including Hepatitis A, Norovirus, E. coli O157:H7, Salmonella, and other dangerous microorganisms.

The contract requires Thermo Fisher Scientific to provide certified original equipment manufacturer (OEM) parts, service by OEM-trained engineers, annual preventative maintenance, unlimited phone support, onsite technical assistance, software updates, and a guaranteed 3-business-day response for repairs. The justification emphasizes that Thermo Fisher is the sole manufacturer capable of providing the highest quality and expedited service, with unique access to parts and specialized engineering expertise. The contract is structured as a firm-fixed-price agreement and is classified as a new requirement under the Simplified Procedures for Certain Commercial Items.
