About this file
This is a Justification for Other Than Full and Open Competition (J&A) document submitted by the U.S. Department of State for a sole-source, Firm-Fixed-Price (FFP) services contract with Efficiencie Solutions for Business.
The U.S. Embassy in Kampala, Uganda seeks to transition its remote utility monitoring infrastructure to a fully managed, contractor-maintained Service Level Agreement (SLA) model. The contract covers comprehensive remote monitoring services for 44 government-owned and leased facilities across Kampala, including generators, backup power systems, and water tank levels. The estimated cost is $2,882 per month ($34,584 annually), with a total estimated contract value of approximately $172,920 for the entire period of performance, inclusive of all option periods. The contractor assumes total operational risk and maintenance liability for all deployed hardware, data communication, and application software integrations. Services include management, technical labor, software licenses, local mobile data communication, regular maintenance (both preventive and corrective/emergency), technical support, and phased replacement of outdated Remote Terminal Units (RTUs) with the newest versions. The monitoring software must enable remote alarm resets and provide detailed, automated performance reports.
The justification cites FAR 6.302-1 (only one responsible source) as the statutory authority for the sole-source award. The government determined that Efficiencie Solutions is the only current contractor operating on-site with demonstrated satisfactory performance, existing operational capability, qualified personnel, and the immediate capacity to absorb required Software-as-Service standards. Market research conducted over the preceding twelve months determined that awarding to another contractor would require substantial additional procurement lead time, mobilization, site familiarization, and operational setup, thereby delaying critical monitoring of generator fuel, alarms, and residential water levels and disrupting government facilities operations. No synopsis was issued on SAM.gov due to the urgent nature of the acquisition and the applicability of the foreign acquisition exception under DOSAR 605.202-70. The Contracting Officer determined the anticipated annual cost of $34,584 to be fair and reasonable based on cost analysis.
