About this file
This is a Justification for Other Than Full and Open Competition (JOFOC) document submitted by the U.S. Department of Health and Human Services, Centers for Disease Control and Prevention for a sole source acquisition.
The acquisition is for the Pregnancy Mortality Surveillance System – TEXAS, administered by the National Center for Chronic Disease Prevention and Health Promotion. The contractor is the Texas Department of State Health Services under existing contract number 75D30121P12352. The requirement covers a base period of 12 months plus four 12-month option periods, with a performance period of September 20, 2026 through September 19, 2027. The estimated total dollar value is redacted. The services required include provision of fully identifiable and linkable vital records data, specifically death certificates for women who died during pregnancy or within one year of the end of pregnancy, along with corresponding birth or fetal death certificates. These records are necessary to support accurate identification and epidemiological analysis of pregnancy-associated mortality cases in Texas. The justification for sole source acquisition under FAR 6.103-1 is based on the Texas Department of State Health Services being the sole legal custodian and authoritative source of vital records for the State of Texas. Market research confirmed that the required identifiable data are exclusively maintained by Texas and unavailable from third-party vendors or alternative sources. The previous contract period ran from September 20, 2021 through September 19, 2025. The contracting officer certified the justification on July 24, 2026, and determined the anticipated price represents best value based on historical pricing analysis.

5. Market Research: Market research was conducted in accordance with FAR Part 10 and included review of prior procurements, consultation with subject matter experts, and assessment of available data sources. Results confirmed the required data are exclusively maintained by the State of Texas and unavailable elsewhere.
6. Procurement history:
a. Contractor: Texas Department of State Health Services Contract or Order Number: 75D30121P12352 Award Date and Period of Performance: 09/20/2021-09/19/2025
7. Actions to Foster Competition for Future, Similar Requirements: Describe what actions will be taken to increase competition before subsequent acquisition of the supplies or services is required. You may state that an action is a one-time requirement, but if a similar requirement arises, effort will be made to compete it to the maximum extent possible. If the action is non-competitive because of proprietary data or licensing rights and there may be a continuing need for the requirement, there must be evidence that advanced planning has been initiated to overcome the barriers to competition, or there should be documentation to support an analysis that replacement costs/licensing purchase costs outweigh the benefits of competition If the action is a contract extension or bridge, explain actions to compete the follow-on. If action is an urgent new requirement and a competitive follow-on is anticipated, explain that efforts are underway to facilitate a full and open competition.
8. Additional Information or Other Facts: The Texas Department of State Health Services is the only responsible source capable of providing the required services, and no other supplies or services will satisfy agency requirements. This acquisition meets the criteria under FAR 6.103-1.
