About this file
This is a Justification for Other than Full and Open Competition (J&A) document submitted by the National Institutes of Health (NIH) Clinical Center Pharmacy Department for a single-source acquisition.
The acquisition seeks to purchase 503(b) compounded intravenous (IV) narcotics for patient care at the NIH Clinical Center, a clinical research hospital. The contracting activity is HHS/NIH, with Fortin Georges serving as the Contracting Officer's Representative (COR). The procurement is structured as a new requirement firm-fixed-price blanket purchase agreement with a base year valued at $110,000 beginning in 2026 and four optional years for a total estimated value of $684,000. The delivery/performance period extends through the optional years. The sole proposed contractor is QUVA PHARMA, INC. (DUNS: 1327585), located at 3 Sugar Creek Center Boulevard Suite 250, Sugar Land, TX 77478-2576. The justification cites 41 U.S.C. 3304(a)(1) and FAR 6.302-1 (Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements) as the statutory authority for non-competitive procurement. The document states that QUVA PHARMA has not designated other distributors of IV narcotics in the U.S., and market research identified only QUVA as a known compounder and distributor. Pricing is established by the manufacturer through their order portal. The agency plans to monitor the market and issue a Sources Sought Notice if new distribution channels emerge for these medications.
