About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document from the U.S. Consulate General in Hermosillo, Mexico for the sole-source acquisition of SIP Circuit and analog telephone lines. The procurement is for a new SIP circuit and 20 analog lines for the telephone system service at the NCC facility, with an estimated cost of $31,220.00 USD for the period of February 25, 2025 through February 24, 2026.

The justification cites TELMEX as the sole responsible source under FAR 6.302-1, as they are the only vendor with proprietary infrastructure capable of providing reliable service without media converters that could degrade quality. While other vendors (TotalPlay, AXTEL, and Metrocarrier) exist in the area, they lack the necessary infrastructure to provide comparable reliability. TELMEX is the incumbent provider, currently supplying the E1 circuit and multipair cable for existing lines. The document notes that TELMEX considers Mission Mexico a VIP client and maintains consistent pricing. Government of Mexico regulations make it difficult for other companies to compete in telecommunications, and no other vendors expressed written interest in the acquisition.

U.S. Consulate Hermosillo

M/GSO Procurement Section JUSTIFICATION AND APPROVAL FOR OTHER

THAN FULL AND OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that US Consulate General Hermosillo use other than full and open competition for the acquisition of a SIP Circuit and analog lines for its telephone system service. The estimated cost is $31,220.00 USD

2. Nature and/or description of the action being approved.

The U.S. Consulate General in Hermosillo seeks to acquire a new SIP circuit and 20 analog lines for its telephone system service at the NCC, for the period of 02/25/2025 through 02/24/2026.

3. Description of the services required to meet US Consulate Hermosillo needs. The US Consulate General requires reliable dedicated SIP Circuit and analog telephone lines for post's telephone system service that can be provided by a local service provider.

4. Identification of the statutory authority permitting other than full and open competition:

Only One Responsible Source (FAR 6.302-1) Citation:

41 U.S.C. 253 (c)(l).

5. Demonstration of contractor's unique qualifications.

TELMEX is the only vendor with proprietary infrastructure that will provide full reliability for the SIP circuit and analog lines for post's Telephone System service from our current range of vendors without the use of media converters of any type, that might degrade the quality of service we receive.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

Other available vendors in the area include TotalPlay, AXTEL and Metrocarrier.

However, its commonly known that none of the other carriers have the proprietary infrastructure to provide the reliability that is needed to support our telephone system at post. Telmex already provides the El circuit for our current telephone system, as well as the multipair cable for our current lines, in order to do this, the other vendors would need to implement the use of media converters, which are proven to attenuate the communications and affect the transmission of voice and data.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The provided quote by TELMEX is within market limit costs.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

TELMEX has provided the service for several years to post and to other posts in the country and considers Mission Mexico a VIP client, which allows them to keep the same cost and ensure the best quality of service possible.

9. Any other facts supporting the use of other than full and open competition. We have worked with TELMEX in the past and since this service provides connection for our main telephone systems network, changing providers will involve several technical steps that might affect reliability towards our clients while adapting to new company procedures in terms of technical escalation or invoicing.

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition. No vendor wrote a letter to express interest.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Actions to enhance competition are difficult as GOM regulations make it difficult for other companies to invest in telecommunications.
